That, and under Article I, Section 6, Congressmen can't be arrested while Congress is in session or while traveling there from home, except for Treason, Felony or Breach of the Peace.
As for Mr. Tice, if he didn't work on the program, he probably wasn't the one who leaked the information to the New York Times. The leaker gave specific information about the program to the newspaper.
