Today was the long-anticipated status hearing on guardianship for Scott.
The hearing took place in judge's chambers with Pamela and her attorneys and Eliza and her attorneys. Pamela presented the judge with information that she has now filed with the court to have Scott declared "partially capacitated". This means, at the very least, that he would then be allowed to indicate his preferences for his social environment, such as who is allowed to visit. He has repeatedly indicated that he does not want to see Eliza, but he does wants to see his son.
Pamela also informed the judge that, after Scott is legally determined to be "partially capacitated", they would be filing for a divorce for him. [emphasis mine]
Eliza indicated to the judge that she would fight any divorce proceedings.
The final item that Pamela presented to the judge is that Scott is scheduled for surgery to close his tracheotomy opening, which should allow him to regain his ability to speak and make sound.
Based on all the above information, Judge Wilkes ruled to grant Pamela another six months of full guardianship of Scott. This will be a crucial time for Pamela and Scott, as they continue to work, not only for Scott's recovery, but for him to regain the right and ability to truly "speak for himself".

God bless Haleigh Poutre! That this is reported with any frequency whatsoever as a "right to die" case is completely repulsive! Those that can't see an agenda when it is placed right in front of them are completely and willingly blind!
My husband just commented that the scenario that the deluded DSS officials saw might have gone something like this:
"Haleigh, if you want to die then squeeze my hand twice." Haleigh doesn't squeeze the hand at all. Not bothering to ask if Haleigh wants to live to squeeze once, the official declares, "Haleigh didn't respond, therefore, she must be PVS and so she must die."
It's about the same as happened to Terri. They can't understand that when Terri said anything when her tube was pulled the last time, that she was no longer PVS. I am still outraged and hurting that we live in such a society. Thank God, I have some of my fellow FReepers to vent with! God forgive us and give us courage to right this wrong!

And if the proper laws aren't there yet, you get some evil lawyers to fix that and then kill her. I'm sure she must have seen a disabled person and wouldn't want to live like that.
So they're not supposed to follow the laws written by the legislature? WTF?

I think that what was meant was that it should be called judicial activism when a judge doesn't follow what the intent of the legislature is. At least that's what I'm interpreting. It is so poorly written that it makes it difficult to tell what point the author was trying to make.
I just read the following article about Haleigh. The first paragrah is from the article - the rest is my ranting.

As is stated in the above paragraph, the DSS spokesman says HALEIGH RESPONDED TO COMMANDS TO PICK UP A STUFFED TOY. This person is one of the people who wanted to kill her only a few weeks ago. Not only is she following commands, she also obviously has the ability to use her arms and hands. Haleigh was fasely diagnoised as PVS, just like Terri. Talk about a junk science term. It's a horrible way to describe a human being. The termonology should be abolished and sent back to h*ll were it came from.
The little angel was first abused by her own family, the DSS, then doctors who think they are gods, who can determine who can recover and even worse - who will live or die. Unbelievable!! I've read other articles about Haleigh. Articles that say the Governor wants to establish a panel to the review the case. I might be missing something, but I don't see where he wants to review the gross error of almost killing her by removing her feeding tube. He seems more interested in reviewing the events leading up to her brain injury, but not the almost fatal mistake of almost killing her.
Another very troubling thing - several of the articles I've read, use almost the same following words: **The governor said the state has no immediate plans to withdraw the girl's life support.** I keep looking for them to say they have NO plans to withdraw her life support (which most likely means her feeding tube). Instead they say no immediate plans or current plans. I don't like the wording they are using. IMO, they are keeping the door open to take away her food and water in the future.
I pray to God that our country wakes up and kicks the culture of death to the curb. They have gotten a huge foothold over the past several decades. Today I watched a program about Charles Lindburg on the history channel. I was shocked to hear that he supported Hitler and made several trips to Germany prior to our involvement in WWII. At the time Lindburg was part of an organization called something like America First. He was also the president of the American EUGENICS Society. The Nazis were impressed with his theories on Eugenics - the perfect race BS - and they put them into affect. It was sickening to realize Hitler got some of his ideas from people in this country.
Just this past week, at the state capital in my state, a group was gathered on the steps, shouting for their RIGHT to kill themselves. As soon as the supreme court ruled in favor of Oregon's Assisted Suicide Law, I figured it wouldn't be long before the very organized death cult, would be busy getting it approved all over the country. Gee, what did they do - wait barely a week?
And then there's Britian, our so called civilized alley, who is actively promoting the forcing of doctors to practice not only abortion, but also euthanasia. How many doctors will be forced to leave medicine because their personal values/morals/beliefs will not be allowed in the work place? How scary is that? Imagine our country's doctors being controlled by those ghoulish bio-ethics characters, who spewed their insane lunacy on our TV's during Terri's 13 days of torture.
Do you know how words are created? I've never liked the sound of the word euthanasia. The meaning is horrible, but the word itself has a sickening sound to it. That probably makes no sense, I know. Well, when I was watching the program about Lindburg and his involvemnent in eugenics, it dawned on me that it also started with the letters *EU*, just like euthanasia. Europe also has the EU too. Do you or anyone else know what the EU means? I remember some here on the Terri threads could break down the meanings of names in the past. I'm curious about this EU thing. I know it's late and this might not make sense. Not much of anything makes sense anymore. I'm also listening to Art Bell right now, as he talks to a guest about a pole shift. Up will be down and down will be up. Sounds appropriate for what's going on in the world these days. :( :(
It appears that Haleigh Poutre may still be alive today and getting a chance to live because of Terri Schindler-Schiavo and the public awareness of right to life issues evolving from the Schiavo case.
