Aren't Jose Padilla and John Walker Lindh both US citizens?

Lidh was properly convicted ... I do not like what is happening with Padilla. As to who gets to decide who a terrorist is ... I hope the FBI CANNOT decide. It should only be the President ....NOT the FBI .... NOT the CIA or the Pentagon ....NOR the NSA.
