Before I begin, I state this disclaimer: I am NOT a lawyer (though not yet, as I'm studying to become one...)

That said, it really depends on whether the magazine can be held to be legally obscene. Here, the Miller test--though commonly used for sexually explicit materal, can apply on the basis that as specified in Miller v. California (413 US 15; 1973), the test makes no specific distinction of obscenity.

Generally, the Courts have ruled that while racist literature in any form is objectionable to most of society, it is rarely obscene by modern definition and is thus considered to be within the realm of protected speech, albeit sometimes barely.

However, the Miller test can be applied to any form of obscenity--be it racial, sexual, etc. in nature. It just has to be shown that the work meets all three criteria, all according to the prevailing community standard. Meaning that if the work is found to appeal to the prurient interest; is patently offensive; and

Though for our edification, allow me to reference several court cases that relate to this generalized philosophy:

• Whitney v. California (274 US 357; 1927). Anita Whitney was convicted of a California statute forbidding criminal syndicalism by founding a pro-Bolshevik group. The Court ruled that a state can impose limits on freedoms of speech and expression if that speech or expression incites crime, advocates the overthrow of the government, or greatly disturbs the peace. Overruled explicitly by Brandenberg v. Ohio (395 US 444; 1969)
• Beauharnais v. Illinois (343 US 250; 1952). The Court upheld the conviction of a white supremacist under Illinois' group libel statute on the grounds that since libel is an individual common-law offense made mala prohibitia in every state, and libel is outside of First Amendment decisions, it therefore stands to reason that if libel can be prosecuted by the state when subject to an individual, the same can and must hold true when dealing with a group.
• Cohen v. California (403 US 15; 1971). A man wearing a jacket with the words "Fuck The Draft" in a courtroom could not be considered as obscene solely on the grounds that by doing so, he is disturbing the peace or making a scene.
• R.A.V. v. City of St. Paul (505 US 377; 1992). The Court ruled that a St. Paul ordinance banning the usage of "fighting words" was too broad and the action was, in Justice Scalia's words, "a viewpoint in the free market of ideas."

So while we may find it personally disgusting and offensive, but unless it is abominable, the odds of the complainant successfully pursuing relief through legal methods are clearly stacked against said complainant. Not to say it cannot happen, though.

I found it interesting to see the reaction of black american soldiers stationed in Germany when they first encountered nightclubs and bars that barred blacks...
Such Outrage !!
Some changed their minds about American attitudes toward race after such an experience..

Most white americans have never really experienced any kind of racism, never been "excluded" for who they are..

Americans in some parts of SE asia are surprised to find they are "not welcome" as well..
Not to mention the Middle East, India, Pakistan, ...
It seems americans, even (especially) white americans are often "discriminated" against in many parts of the world..

Americans have never experienced racism until they leave America and go somewhere else..
It's everywhere..

Why are black supremacy organizations such as the NAACP, PUSH and the Rainbow Coalition seen as OK and even get tax money, while white supremacy organizations are always condemned?

You need to go back to the founding principles of the Communist movement for an answer. In order to defeat America the plan was to attack the foundations of society rather then a traditional military action. So anything that anybody can invent that is outside the normal WASP mind set is promoted over and above the traditional WASP culture. This gives us gay rights, tolerance, drugs, crime without any real punishment, welfare, and most importantly multiculturalism. The best way to eliminate that hard working, god fearing, tax paying, military enlisting WASP was to dilute him with lazy bums from all over the world. Rome went the same way but it was an accident that was not seen coming. In this case it is quite deliberate.
