A totally agree. Like I mentioned before, this is a beef I have with the legislative not the executive. By not issuing a formal declaration of war they get the benefit of the positive image of having supported the war if things go well and can turn around and deny responsibility (actually shift it to the executive) if things go poorly.

In Hamdi vs Rumsfeld the Supreme Court was quite clear that an AUMF is just a "nuanced" Declaration of War. It is the same thing. Tommy Daschle doesn't get a "Do over".
