Probably because he doesn't have $72,000 in siezable assets in the first place.

Since when did that stop the courts from desiring that somebody has to pay a fine?

In civil matters, such as this one, the plantiffs usually decide whether or not to seek damages and the ability to collect a judgement goes a long way toward deciding whether to seek one in the first place.
