NEW YORK - The National Security Agency has conducted much broader surveillance of e-mails and phone calls — without court orders — than the Bush administration has acknowledged, The New York Times reported on its Web site.

The NSA, with help from American telecommunications companies, obtained access to streams of domestic and international communications, said the Times in the report late Friday, citing unidentified current and former government officials.

But what are the limits? Could the NYT publish the nuclear launch codes and get away with it?

Brief history of the Espionage Act (18 USC 793, et seq) ...

Publisher of an anti-draft pamphlet was jailed, and the conviction was upheld in Schenck v. United States, 249 U.S. 47 (1919).

Rosenberg isn't a good example for this case. They were accused, convicted and sentenced for passing information surreptitiously. Hansen would be a more apt corrolary to Rosenberg.

Ellsberg and The Pentagon Papers is a decent starting point too.

citing unidentified current and former government officials.

This to me means I can dismiss anything that is said after that point as bluster and nothing more than opinion.

If fact exists and someone stated them then there should be no problem putting names with those statements.

I offer that when most folks dismiss these UNSOURCED claims they will stop providing this fodder.

One also needs a barf bag when visiting airport News & Gift shops. Half the publications (or more) have some kind of leftist lunatic pitch on the cover, or above the fold. "Bush Lied About (fill in the blank), or "Recession Likely, Say 'Experts'", "Troops War Criminals - Sen. Kerry". The media has zero credibility.

Well, we don't need the NSA to tell us whose side the NYT is on.
Anybody can read their anti-American terrorist sympathizing poison.

I think it's about time to start posting a bounty on NYT reporters.

I don't fly much any more. My oldest son agrees with you and takes his own book choices and magazine choices with him when he flies.

With CNN news only in the bars and restaurants in airports and what you pointed out, this son says that airports have been and are still liberal havens for their biased PR.

I see no reason for any of this program to be made public. My rights aren't violated by the NSA. The NYT should be put of business within the next few years by the American people. It's up to us. They are nothing but traitorous SOB's.
