BUSH JUDICIAL APPOINTMENTS TO THE FEDERAL APPELLATE BENCH: 2001-2005
(6 Currently Pending)
FYI: I have compiled the information available on Bush Nominees for the Federal Appellate Bench for all to use. Feel free to correct me if need be.
Current Status of Federal Appellate Nominees:
Bush Judicial Appointments: 50
Judges Confirmed: 41
Recess Appointments: 2; Pickering Now Retired, Pryor Now Confirmed
Still Pending: 6; Terrence W. Boyle; William James Haynes, II; Claude Alexander Allen; Henry W. Saad; William Gerry Myers, III; Brett M. Kavanaugh
Withdrawn: 2; Miguel Estrada; Carolyn Kuhl
Confirmed Judges No Longer on Federal Appeals Bench: 2
1) 3rd Circuit - Michael Chertoff Now DHS Secretary
2) DC Circuit John Glover Roberts, Jr. Now Chief Justice SCOTUS
President Bush has appointed 50 people to fill vacancies on the Federal Appeals Courts over the last five years. Of these appointees, only 41 have been confirmed. Many of those confirmed have had to be re-appointed, some more than once, in order to go around Democrats who refused to vote them out of committee in 2001 and 2002 after the Jim Jeffords move gave control of the Senate to the Democrats.
There have been 16 appointees that have been filibustered and some continue to be filibustered. Some have been filibustered on the Senate floor after making it out of committee in a Republican controlled Senate in 2003 and 2004, many more still pending, now withdrawn or retired have been threatened with a filibuster. The Gang of 14 did allow for an up or down vote on some of the judges being filibustered. Still, the Gang of 14 group has failed to prevent Senate Democrats from both dragging their feet and threatening unconstitutional filibusters on highly qualified judicial appointments.
This is also being done by Democrats to prevent President Bush from filling the remaining vacancies on the Federal Appellate Bench by slowing down the process.

You have done us a great service. Now, I have a question. Remember the great deal made with the gang of fourteen? I forget how many were being filibustered at that point, but whatever happened with all that. I think 2 were confirmed as part of the deal and the rest were to be brought up for votes. Am I right about that, and MUCH MORE IMPORTANTLY, were any of the others actually brought up for a vote? Please clue me in if you can. Thanks.
I believe Owens, Pryor, Brown, McKeague, Neilsen, Griffen and Griffith have been confirmed since the Gang of 14.
Terrence W. Boyle; William James Haynes, II; Henry W. Saad; William Gerry Myers, III; Brett M. Kavanaugh
All of the above were renominated in February 2005.
Claude Alexander Allen was not re-nominated in February 2005. I believe his nomination late last year is also still pending and did not require a re-nomination.
I've been wondering why Bush STILL hasn't nominated a replacement for Pickering on the 5th circuit- he resigned over a year ago. This deal with the Gang of 14 not to fillibuster only lasts til next November- he needs to hurry up and nominate someone. Should have many months ago.
I am trying to find out how many vacancies there are on all 13 Courts of the Appellate Courts, 1 through 11, DC and Federal.
I mistakenly wrote: U.S. Circuit Court of Appeals for the 2nd Circuit
It should be: U.S. Court of Appeals for the 2nd Circuit
I repeated this mistake throughout the post with the exception of the: U.S. Court of Appeals for the 1st Circuit
Sorry about that.
Over all the president has done a fine job with judicial nominations. The Ninth Circus on the other hand, well let's just say it will keep providing us with punchlines for years to come.
He was one of two Clintonistas appointed by Bush in 'the new tone era'.

I had blocked out this horrible move by Bush.
So total appointees is 51 with 42 confirmed, 6 pending and 3 withdrawn or retired.
