Sorry but I still don't agree with this scope of Federal power. If you don't like what a local school board has done, or if some wolves in sheeps clothing mangage to get elected they can be voted out in the next election. (Which is exactly what happened). If a Federal Judge scews you in deciding what can and can't be taught, you are stuck - you stay screwed.

If an extremely hypothetical mayor declared Islam to be the "official religion" of his city and enacted a host of restrictive religious laws, would you say "That's okay, he'll get voted out in X number of years?" What if a tiny majority of eligible voters support him?
My point: The courts exist for a reason. When elected officials make illegal decrees in violation of the constitution, turning to the judiciary is the citizens' recourse.
