"the lower courts generally refused, on “political question” grounds, to adjudicate the matter. In the absence of judicial elucidation, the Congress and the President have been required to accommodate themselves in the controversy to accept from each other less than each has been willing to accept but more than either has been willing to grant."

Most recent case law on the intelligence issue;
A 2002 case dubbed: "In Re: Sealed Case," the FISA appeals court decision cited a previous FISA case [U.S. v. Truong], where a federal court "held that the President did have inherent authority to conduct warrantless searches to obtain foreign intelligence information."

One can go back and forth about who's right and what's constitutional right but that's why current case law and previous Presidential authories support what this President is doing with regards to foreign intelligence stretching overseas and the conduct with the war on terrorism.

And taken to the woodshed for coming to the fight on a front porch armed with only a Swiss Army knife.

What I posted was neither "stupid" nor "juvenile";...

In your mind maybe but then you continue you ignorant assessments of what was said.

I made no "personal attack" on you. If I had done, believe me, you would know it!

And I would say exactly the same things, in person, that I post to FR.

I suggest that you read the post I was replying to, since you may have imagined that it was internment camps that you were speaking about, but you mentioned "attack".

If you don't respond to me, I shan't respond to you...unless you post a reply that I want to reply to. :-)

The FFs wanted Senators to be picked by...STATE PARTY HACKS.

They set up the Electoral College, imagining that it would usually be tied, and that Congress would then pick the president. If that were the case today, you still wouldn't be happy with the results...would you?

Bless your heart..I can see why you are so perturbed by requirements for your government run PO Box. How can we possibly worry about our troops in harms way when you can't muster up an address and ID to rent a mail box.

Stop the war! Forget about the terrorists..This man is being INCONVENIENCED!

The airlines have confiscated all the Swiss Army Knives, doncha know? More than likely a wedding set of serrated steak knives. (if they haven't already searched all the homes and taken out the sharp objects)

I do fear the government is trying to build a database on where everyone lives.

What, they've never heard of a telephone book, or a city utilities database? They don't need to get your address from the post office.

Does anyone remember when conservative meant limited government?

Limited to the Constitutional functions. National Defense is the prime reason, although not the only one, we even have a federal government that is as strong as it is. The perception during the late 1780s was that the central government under the Articles of Confederation was not as strong as it needed to be to do it's job. Hence the Constitution, which did create a stronger central government.

The fact that that central government had grabbed extra-constitutional powers doesn not negate the fact that it does have Constitutional powers and duties.

Is it possible that with a bad person at the helm of this country the law could be harmful? I would think so.

With a bad person at the helm, it really doesn't much matter what the laws are. Bad people don't obey them you know. Just look at the period 1993-2000 to see how that works. That Administration did a whole lot more snooping on US Citizens, let alone "US Persons, which includes nominally legal aliens, even those who have overstayed student or other temporary visas, than this one, and they did it without the Patriot act.

Making a list and checking it twice. Checking to see who's naughty and who's nice. :)
