Here's a hint, when Jackson was researching to write his opinion, one obvious area of research would have been Lincoln's suspension of habeous corpus and other acts and the courts reaction.
And relying on the "majority of resources" is not wise when that "majority" is in fact the hacks of lamestream media who all get their information from each other or the internet. Remember, the internet is mostly a repository of popular opinion that has been published in the last 10-15 years and very little original research. It does not yet have the entirety of human knowledge stored.
I think Lincoln was very likely to have quipped something like the statement.
