Yeah, no judge is gonna put this kid away. I wouldn't go rewarding him, though. I'd just make sure that he understood that what he did was wrong (questionable; he's only 10), give him a slap on the wrist, and send him on his way.
I'm pretty sure the SS and FBI will have his file in the cabinet with the big red flag.
