Treason merely requires the existence of enemies of these United States; it does not require a declaration of war. In any case, we already have a declaration of war from Usama himself, and with the tragic attacks on New York City, we cannot argue that he lacks deadly seriousness.

The only instances of any prosecution for treason in the US has been during a formally declared war under article 1 section 8 clause 11. If this had been done instead of a simple authorization by the Congress for the commander in chief to prosecute a UN resolution, you wouldn't be hearing any of what you're hearing now.
