Oldest Calif death row inmate seeks execution stay

SAN FRANCISCO (AP) - Lawyers for Clarence Ray Allen, the oldest man on California's death row, asked a federal judge here late Wednesday to block his scheduled Jan. 17 execution.

Allen, 75, recently suffered a heart attack, is blind, has diabetes and frequently uses a wheelchair. His attorneys in a lawsuit say poor medical care from the California Department of Corrections and Rehabilitation is hampering Allen from assisting them in preparing a clemency petition, which is due to Gov. Arnold Schwarzenegger by Dec. 13.

His attorneys say Allen is brain damaged, but his poor health condition and lack of medical care is hampering his attorneys and doctors from properly diagnosing him. The lawsuit seeks to block the execution.

"Knowing that Mr. Allen is facing an imminent execution date, after Mr. Allen's heart attack, defendants simply patched up Mr. Allen enough to execute him and have denied him the medical care to which he is entitled," attorney Annette Carnegie wrote.

The lawsuit against the prison department alleges that since Allen's heart attack in September, he has been denied proper medications or they have been administered sporadically, and he has not been provided bypass surgery as recommended.

The state Attorney General's office, which defends the Corrections Department, declined to comment late Wednesday, saying it had not yet seen the lawsuit.

Allen was sentenced to death for hiring a hit man who murdered three people at a Fresno market. Allen, who was already in prison for murder, had the trio killed because he feared their testimony would hurt his chances of prevailing on appeal.

The convicted hit man, Billy Ray Hamilton, also is on death row. Prosecutors said Hamilton was following Allen's orders when he killed Bryon Schletewitz, Douglas Scott White and Josephine Rocha in 1980.

The case is Allen v. Hickman, 05-5051.

Sure, where is your humanity, but leave the I V's in him so they can hook him up to the needle quicker. Why not let some pre med student practice on him. Just explain to him that cardiac rehab will not be required.

Less the Taxpayers have to spend on this waste of good oxygen

Now if this were an innocent person whose next-of-kin were trying to have him put down, the libs would be shilling for him to die.

How come no one is standing up for this fine citizen like they are for Tookie? After he only killed 3 people, one less than Tookie and is in bad health.(/sarcasm)

At least 4, but who's counting? As long as they are sick, disabled, or write children's books, let them all live! Heck, imprisonment is cruel and usual imprisonment. Let's just let them all out and give them welfare for life. After all, they have been deprived all this time of developing marketable skills to find a job.

I hereby offer to perform a heart transplant (using tookies' preserved heart of course) for this fine gentleman utilizing my vast skills as an Electrical Engineer and my having watched one being done on Discovery Channel.

Well if your too busy to perform the operation I could take your place. I am not a electrical engineer and I haven't seen one done on the Discovery Channel. But I did stay in a Holliday Inn Express last night.

You can assist as I have seen the Discovery Channel operation.

BTW do you have a good Saws All for opening him up as mine has wood sap on it.

Also bring a pneumatic or roofing stapler for closing up afterward......I've got a 5hp compressor but no stapler.

If you stop and think about it, isn't that really just a prolonged version of the death penalty? Whether they are hanged, electrocuted, shot, decapitated or die of old age the outcome is the same. So it's not a matter of function, but rather a matter of form. Using this reasoning means that to do away with the death penalty means you would have to assure that no one in prison for murder ever dies of any cause.

Hmmm...
