San Francisco officials decided Wednesday to keep open a lot that has been used to sell Christmas trees during the holidays for the past 40 years.
The five-member Board of Appeals unanimously voted to turn down resident Monio Pilpel's appeal of city permits that allow Cyril Hackett and his family to sell trees at the corner of Sloat Boulevard and 19th Avenue before Christmas. Hackett's popular lot is also transformed into a pumpkin patch around Halloween.
The case drew an emotional standing-room crowd to City Hall, with most supporting Hackett's claim that the lot is a city "tradition." Hackett will have to follow a set of conditions that Supervisor Sean Elsbernd recommended to the board.
"The city made the right decision," Hackett said. "We can continue the tradition for the sake of the kids and families in San Francisco. (The lot) is a treasure, and it should be kept."
Pilpel, however, characterized it as blight to the neighborhood. He has complained that during the eight months of the year that the lot isn't used to hawk holiday fare, it isn't cleaned up and looks trashy. In addition, the owners don't always obtain proper permits to erect or tear down structures, he said.
"Each year, they say they'll clean the lot, and they don't, and it's a public nuisance," said Pilpel, who has lived in his home about a half-mile away for the past 34 years. "They've been bad citizens all this time."
In his complaint, Pilpel asked that the lot not be used to sell anything for the rest of 2005.

Sell porn and allow strip shows along Market Street? No problem. Sell Christmas trees?! Oh my gosh, how offensive!!!
Perhaps it could double as a flea market.
David Pilpel said the motion should be adopted because no one was present at the Board hearing and that the neighbors had been promised no McDonald's at the CU hearing in 1988. Monio Pilpel, father of David, repeated that they were promised no McDonald's and the conditions of the CU have been violated over the years. Parking is the greatest problems there right now and the proposed restaurant would badly exacerbate the problem.

To show there`s no hard feelings , I think Mr. Hackett should give Mr.Pilpel a free Christmas tree.
That should brighten up Mr. Pilpel`s holiday mood.........
