Prescription for firings: Call Walgreens boycott

A Southern Illinois abortion foe, backed by her local Catholic diocese, is asking consumers to pull their prescriptions from Walgreens until four pharmacists, on unpaid leave for refusing to agree to fill orders for the morning-after contraceptive pill, are reinstated.

Ann Polka, manager for the Belleville Diocese's Project Rachel, a post-abortion healing program, is also asking regional residents to refrain from doing other shopping at the chain's stores.

"This is an unjust action," Polka told the Belleville, Illinois, News-Democrat. "They are being let go because they couldn't in good conscience dispense the drugs."

At issue is the Plan B morning-after contraceptive – not to be confused with RU486, the abortion pill used to terminate later-term pregnancies. Plan B contraceptives are essentially very high, multiple dosages of birth-control pills taken within 72 hours of unprotected sex to prevent ovulation or implantation. If ovulation is prevented, no egg is fertilized and no pregnancy occurs. But if ovulation has taken place and the egg is fertilized, the morning-after pill works to block implantation by the early embryo in the mother's womb. It is aborted, making dispensing prescriptions for the pill a matter of conscience for pro-life pharmacists.

Walgreens, in a statement following last Monday's suspensions, defended its action saying the company's policy is consistent with an Illinois state rule mandating pharmacists fill prescriptions without delay.

Illinois Gov. Rod Blagojevich filed an emergency rule April 1 requiring pharmacies to honor all Food and Drug Administration-approved contraception prescriptions. The rule is the only one of its kind in the U.S. and became permanent on Aug. 1.

"If a woman has a prescription for contraceptives, they ought to be filling that," Blagojevich told the St. Louis Post-Dispatch, adding that the pharmacists' suspensions were unfortunate but not as important as protecting women's rights.

"This (rule) is unjustly imposed on Illinois by Rod Blagojevich," Polka said. "It's puzzling to me that pharmacists do not have a discretionary power."

"[Pharmacists] certainly have the right to their personal opinions, but that cannot get in the way of a woman's right to get the care that her doctor has prescribed for her," Blagojevich spokeswoman Abby Ottenhoff said. "If it is approved by the FDA and approved by a doctor, it is not a pharmacist's place to deny access."

Ottenhoff noted the law does provide an exception – pharmacies can either sell the Plan B pill along with any other contraceptives they offer or they can refuse to sell any contraceptives at all.

"It's up to the pharmacy, how they decide to comply with the rule," she said. "In this case, Walgreens did what they felt they needed to do to comply with the law in Illinois."

Pharmacists opposed to dispensing the pill are free to apply for positions at pharmacies making the later choice – or move out of state.

John Menges, one of the four Illinois pharmacists dismissed last week for refusing to sign a Walgreens pledge to dispense the pill, may have to make that choice. Thus far, Walgreens hasn't offered him a position across the Mississippi River in neighboring Missouri where pharmacists' right to conscience is recognized, but three Illinois pharmacies have contacted him.

Menges, 39, believes the FDA erred in classifying Plan B as an oral contraceptive since it acts, in at least some cases, as an abortifacient – it prevents birth rather than pregnancy. He, along with five other Southern Illinois pharmacists, are suing Illinois to end the Blagojevich rule.

Polka has marshaled the support of her diocese for the Walgreens boycott. An announcement will go out to all parishes in the church's next monthly mailing.

"These pharmacists are very courageous," she said. "We as Catholic Christians need to stand behind this."

If you boycott Illinois, that won't change the law. If you apply pressure on the community of large corporate sponsors who finance political campaigns, then you can get the attention of amoral cash-hounds like Gov Rod. Then laws can be changed to accommodate the highest bidder.

They were offered employment in another state in order to still have a job with walgreens AND not have to dispense these drugs.

That's why people don't like the boycott. Because calling for one is idiotic and just makes the people who are opposed to this bad law look bad by association.

Isn't Walgreens a publicly traded store? If so, they have more than a 'right' to follow the law. Their first obligation is to their owners, and in accordance with that, they have an obligation to follow the law.

Consumers have every right to take their business elsewhere. Even to organize a boycott. I just think it's stupid (and wrong) to boycott the weak party (Walgreens) instead of those who could change things.

BTW, HIPPA aside, they should get the names of the doctors that prescribed the stuff and consider boycotting them.

Pharmacists refuse to fill various presciptions every day for many different reasons: drug interactions, allergies, wrong doses, forgery, legal parameters,

And when one of those presciptions is presented. the pharmacist simply does not process it. And allows the person who presented it to leave and try at another pharmacy. Right.

Okay,one more time. What they are doiong is violating the state's statutes in favor of a contradictory executive order. The order is illegal on the face, but as you probably know, being a conservative, conservatives never get injunctions, liberals usually do. Just because Blago makes an illegal document doesn't mean anybody should follow it.

The Illinois Health Care Right of Conscience Act declares that it is the public policy of Illinois “to respect and protect the right of conscience of all persons who refuse . . . to act contrary to their conscience or conscientious convictions in refusing to obtain, receive, accept, deliver, pay for, or arrange for the payment of health care services and medical care.”

OK, if I (finally) understand what you just posted, this is a no win situation for Walgreen’s.

Ignore the law on the books, they're in trouble with the law, and will end up in court. Ignore the contradicting executive order, and I imagine they could be hauled into court for ignoring the order.

Walgreen’s first obligation is to it's owners, the stockholders. Management evidently decided that the least risky path to follow was to follow the (illegal) executive order. Given the contradicting situation set up by the government, they're fulfilling their duty to stockholders

What I'm not understanding in all this is why some want to punish Walgreen's for being caught in situation beyond their control, and taking the rational path out. It's like expelling a student after he's jumped by a bully.

The more I read about this case the more convinced I am that there are two bullies involved. The state, and whoever it is that's leading the charge to punish Walgreen's for reacting in a rational mannner.

OK, it wasn't passed by the legislature (I thought I had made that abundantly clear in my last post, I must not have). Does that mean there are no legal consequences to Walgreen's for disobeying it?

I don't know, but I'd guess there are legal consequences to Walgreens if they ignore it. The rational response by management in fulfilling their duties to the stockholders is to do what they did. Furthermore, the compassionate thing to do for their employees is to do what they did.

The irresponsible parties are the Governor, and those calling for a boycott of Walgreens. The Governor is doing it for political purposes, to cater to the Pro-Choice crowd. But why are the boycotters beating up on the innocent? Ignorance? Meanspiritedness?

I don't really think they are innocent. Osco (another big chain) has not done this. I imagine there were a lot of laws on the books Jim Crow era south that might have been legal, but were horribly wrong. "Just following orders" is not an excuse. Perhaps a corporate person doesn't have a conscience, but real people's first obligation is to follow God's natural law, written on their hearts (if they do not have Faith, at least to follow a good moral code.) When a corporate conscience leads them to stock porno in plain view (many gas stations) and vibrators (Target stores). They may believe they are fulfilling their obligation to their stock-holders. This is not the right order of things.

If this were about something that was truly sectarian (e.g. no animal by-products in the gel caps) I would agree with you. Even the regular sometimes abortifacient low-estrogen birth control pills often prevent implantation of the child. (At least those pills have some alternative uses, such as regulating cycles of women with endometriosis) But the "Plan B" pill in question has one purpose, and one purpose only: to kill the already conceived child. (Hence, "morning after").

Half of these boycotts are meaningless because the boycotters don't buy the product anyway. Walgreens is different. I personally treat it as a convenience store (I don't need to take medications). Well, no more.

When the customer walked into Osco and demanded that their prescriptions be filled, and the pharmacist refused, what DID Osco do?

I'd guess it hasn't happened yet. The Left doesn't usually work that way.

The Left has picked Walgreen's as their first target. Fortunately for the Lefties, the boycotters are falling in line behind them to help cripple Walgreen's. It won't take so long that way.

Osco will be easier.

I wholeheartedly agree with your post, and in fact have tried to make the same argument (about the doctors being ordered to perform abortions) many times. Each time I get shot down and told 'they just need to do their jobs'. I just don't get it.

Of course this is what happens. Pharmacists are not confiscating these prescriptions from people, just asking them to go elsewhere. What's wrong with that?
