If the answer to these questions is no, then he should try to appeal to the State Supreme Court. Why spend a small fortune on a lawyer for a long-odds shot at a reversal? It might be a better idea for him to petition his state legislators to change this obviously unjust law.

Will the law change effect him retroactively? I know that laws that make actions a crime can not be applied retroactively. I assumed that changing the law would be the same that is why I suggested going to the State Supreme Court.
