Good point. If the government goons consider your trash not to be yours once it is out, then you are no longer responsible for what it may contain.
(For the enivro whackos here on FR, don't bother flaming me. Forced household recycling is a collectivist exercise, a waste of time and money, and we are not running out of resources or landfill space. If you believe otherwise then you are under 35 and were brainwashed in gradeschool.)
Mostly wrong. Follow the link in post #11.
They have mandatory socialist recycling schemes nationwide.
Other than that, you don't know what you are talking about. Outside of San Francisco, living and working California is like anywhere else in the country (except that we make a lot more money and have far nicer weather). California is the best place in the country to live and work. I lived in Montana and Wyoming and loved it there, but I came back to California becasue it has far, far more to offer.
The leftists in charge are temporary and we'll get our legislature back soon enough.
"Mostly"
Already read that link:
'Law enforcement officers should understand that the fourth
amendment is implicated when they enter an area of curtilage not
accessible to the public. Entry by officers into such areas to
retrieve trash put out for collection is a search under the
fourth amendment that requires a search warrant based on
probable cause. Thus, where trash is placed for collection in an area of
curtilage not immediately accessible to the public, a search
warrant is generally required to authorize police entry into
that area to remove and inspect trash.'
Ex: United States v. Certain Real Property
That gooey white liquid turns into a rock hard shellac.
Right. It has to be "in an area of curtilage not immediately accessible to the public", not just anywhere in the curtilage, which was your original statement.
"If your garbage is contained within areas of curtilage(private property)"
Nowhere in my original post did i use the word "anywhere" or imply it.
I was non-specific but I did mean to imply that it be on private property where not just any tom ,dick or harry could walk right up to it.That`s just common sense.
I know in my area the garbage men regulary go through trash, looking for anything of value. Then complain when they get cuts on their hands which was the phony pretext to mandate garbage bin use by every homeowner.A canard that the city could not or would not prove through records,ie; workers compensation forms/leave.A gift for the lazy union.
BTW, the thought of handling strangers' garbage with hands that have open wounds is disturbing. Depending on the stranger, it could be terrifying.
There's plenty of space for landfills in this country.
I hope you're right. :-)
I agree. Let's start with Chappaqua, New York; San Francisco and the entire state of Massachusetts. Chappaqua is a prime site for a toxic waste dump too.
I remember your rant about this subject, two or three years ago...IIRC, you got some pretty heavy flames!
You have a good memory my friend. I couldn't believe how many Freepers had been brainwashed by the envirowhackos. That's why I included the little disclaimer rant above.
If that's a picture of you, you are going to have a whole lot of fans among the fellas here on FR.
Sorry, I still live in America. Can you tell me what an illegal yard sale is?
How hard is it to legally exercise your 2nd Amendment rights?
There's plenty of room but no one will let you build one (NIMBY), at least not near enough to the area that needs to get rid of it's garbage. Or the cost of building one is so prohibitive because of restrictions, legalities, and regulations that no company will open one. The net result is the same as being out of room - not enough places to put it. If you fill up the existing ones and they don't let you build any new ones you've got a problem.
Frankly, I'd prefer that they burn it and use the energy to generate electricity, then bury the ash or use it to make asphalt or something. But you're not allowed to do that either. A trash burning facility near my parents in New York has been tied up in the courts since I was in high school (and I'm 41!) because of air regulations. It's run for about 6 months out of 30 years.
