Yes, thank SCOTUS. For returning this issue back to where it belonged. The states. The 5th Amendment, nor any of the Amendments were meant to be incorporated. The original intent of the Constitution is that the Bill of Rights applied to the federal government only. This issue was intended to be, and should be, addressed by the respective state legislatures.

Of course that's an originalist POV, not a Republican or Democrat one.

NO. The bill of Rights does not establish rights of freedom from federal government only. Rather it establishes an umbrella of guarantees that extend to all citizens and are the basis on which states can join the union. Thus the justice department can and does enforce the rights against cities and states who violoate them.
