Joe DiGenova said the very same thing on Britt Hume's show. It's coming up for re-run on FOXNEWS in 20 minutes, at 11 CST. DiGenova's segment is about ten minutes in, and it is definitely worth seeing.

I'm not saying Babbin's wrong, but Fitzgerald strikes me as the kind of guy who would rather play hopscotch with a prison rapist than walk away from a prosecution against Libby.

Babbin also mentioned that Libby's attorney is a 6'4" defense attorney who happens to be black.
"Considering the district and that 9 to 10 jurors will likely be black, Libby's attorney is so skilled, he will have these jurors wanting to donate to Libby's defense fund when all is said and done." (paraphrase of Babbin)

Or 4), he drags the indictment out for as long as possible, embarrassed to have wasted tens of millions for this ending, hoping that another shoe falls for a better charge or a better excuse arises to drop charges.

I saw that as well. DiGenova was adamant about the duty this disclosure of Woodward's places on Fitzgerald since it blows the timeline he put forward.

If Babbin's right, I'd expect Libby's attorney to have a motion to dismiss the indictment waiting on the judge's desk for him to read over his morning coffee.
Poor Fitz - that shot at being AG in the Hillary administration just flew out the window, I'm afraid, no matter how this turns out. I might even be able to feel a little bit sorry for him if I try really hard.
Naaaah.
