This is the new playbook. Try to tie up the war leadership in court. Its a win-win for the Anti-war Left. Even if the administration avoids going to court over this, Rumsfeld's good name is dragged throught he mud, and its a wonderful propaganda opportunity, a gift that keeps on giving.
You don't even have to be able to prove anything you have charged, you simply demand access to classified information in order to make your case; if there is no evidence, you charge that the administration is engaged in a coverup.
Meanwhile the administration is made to look as if it is a punch-drunk boxer swaying on its feet, which should be easy given the complicity of a corrupt and hostile press.
The best answer is to make it clear that these charges will not be adjudicated in civil courts. Soldiers are under military law, and will be judged in military courts. The proceedings will not be public.
If it never happened, the administration should be forthright in saying that it never happened. Be bold, be unapologetic. The people who are against the war already think you're guilty, and they are against the war whether you are guilty or not, so they don't matter. The people who are for you will give you the benefit of the doubt. They don't expect you to be perfect, they expect you to fight.
Keep carrying the fight to the enemy, boldly confront the liars in the press, and the patriot crowd will be there for you right down to the end.

I'd be quite happy to demonstrate real torture for any ACLU lawyer willing to participate.
If they'd been picked on in the cafeteria, they'd have the ACLU suing the school.
If they'd been released to go home, they'd be dead (in Jordan, blowing up Sunni wedding guests).

We're baddies for "torturing" our enemies? That isn't half as bad as supporting them. And that's exactly what the leftists are doing.
Can't we just quit pretending these whining sand scabs are human beings and exterminate them? Do they teach ANY manly virtues in that culture, or is it owned lock, stock, and camel by repressed bed-wetters and scrawny girly-boys who beat up on women and cornhole their juniors?
