WASHINGTON President Bush (search) said Friday that he is disappointed he won't get a new Supreme Court justice by Christmas as he wanted.
Senate confirmation hearings for Bush's Supreme Court nominee, Samuel Alito (search), are set to begin Jan. 9, with the intention of a final confirmation vote on Jan. 20. The president had called for a pre-Christmas confirmation for the conservative judge.
"I'm disappointed in the date but happy they do have a firm date for his confirmation hearing," Bush said while in Mar del Plata, Argentina, for the 34-nation Summit of the Americas.
The president plugged his nominee, whom he announced Monday as his pick to replace retiring Justice Sandra Day O'Connor (search), a swing vote on contentious issues such as abortion and affirmative action. Alito is Bush's second nomine for the job; White House counsel Harriet Miers withdrew her nomination last week after withering criticism from conservatives.
"Sam Alito Jr. is an incredibly intelligent, well-qualified person who should be on the court," Bush said.

Can't Arlen EVER be a true republican. Just once. It's also worrisome because methinks that they're delaying it strategically to keep O'Connor on the bench to hear particular cases.

Can Chief Justice Roberts, if he suspects that is what's happening, delay the presenting of that case (until the confirmation hearing has completed)? I probably know the answer to that one, but I had to ask.
Chief Justice Roberts should table all cases until after Alito is sworn in. That way O'Conner will not be able to affect the outcome of any pending issues before the court during this session.
That second date in Jan2006 is going to slip.

Arlen was a HORRID choice. He still is. These hacks are just trying to delay the presence of Alito (his conservative vote) on the SCOTUS for as long as possible. It is my hope that when he does become active, they will OVERTURN the anti-Constitutional decision on the property rights issue in Connecticut, and erase the unconstitutional precedent which is already being abused by LIBERAL LOCAL GOVERNMENTS (5th amendment violation!)
I want to say Roberts got 3 to 4 days of hearings. But Roberts schooled the Dims so badly that they couldn't wait to wrap that up and lick their wounds.
I thought Roberts appeared before the committee on 2 days.
It isn't Specter's fault for the delay. Congress always adjourns early -- every year, period.
Roberts can order that a case be re-argued before the Court, after Alito joins. That way, Alito will get to vote.
Maybe - I just don't recall. Let's call it three and split the difference, at least until someone comes along and educates us. :)
Bush should have expected this BS when he choose to campaign for Arlen Specter over a real conservative like Pat Toomey.
Just call O'Connor to the white house and ask if she'll step aside for a recess appointment. If she says yes, recess appoint Alito so he can hear the important cases until his confirmation hearings start on January 9.
They'll try with all their might to keep pushing that date back, and Specter will do everything he can to accomodate them. It'll be up to us to jump hard on Specter when he starts playing their game.
