United States Attorney Seeks to Forfeit Five Motels

PHOENIX - Indictments charging 13 owners and former owners of six motels on Main Street in Mesa, Arizona were unsealed late yesterday. The indictments charge the defendants with harboring illegal aliens and allege that the businesses facilitated organized human smuggling. The government is seeking forfeiture of five of those properties following a nine-month undercover probe by U.S. Immigration and Customs Enforcement (ICE).

The initial results of the investigation were announced here this morning by U.S. Attorney Paul K. Charlton and ICE Special Agent-in-Charge Roberto G. Medina, who say the case underscores a commitment by the Departments of Justice and Homeland Security to aggressively investigate and prosecute human smuggling organizations and those who profit from this criminal enterprise.

According to the indictments, on numerous occasions the defendants rented rooms to undercover officers posing as human smugglers, with some charging the smugglers higher rates than their ordinary customers. The indictments go on to describe how some of the defendants allegedly coached the undercover officers on ways to conceal their smuggling activities, advising them to register under false names, rent multiple rooms, and park their vehicles in places that would avoid attracting attention.

Officers from ICE who were assisted by officers from the Mesa Police Department executed search warrants on five of the businesses named in the indictments. All of the defendants, with the exception of one, have been arrested. The final suspect, Roshankumar Bharatbhai Bhakta, is a fugitive and is still being sought.

U.S. Attorney Paul K. Charlton stated that “this investigation, as with others conducted in Arizona, demonstrates the extent to which the illegal alien smuggling industry has infiltrated and infected legitimate businesses. Unfortunately, it would appear that the potential for large profits has caused some business owners to not only turn a blind eye to illegal activity, but as these indictments indicate, in many instances to be complicit in their commission.”

“Human smuggling is a ruthless criminal enterprise that puts the safety of our communities and even our country at risk,” Special Agent in Charge Medina said. “These indictments should serve as sobering warning that ICE is targeting not only the criminal networks directly responsible, but also those who profit from it. Businesses like these that collude with human smugglers bear a substantial responsibility for the violence and bloodshed that this illicit trade generates.”

Each of the defendants in the case is charged with one count of conspiring to harbor illegal aliens, an offense that carries a maximum sentence of 10 years in prison and a $250,000 fine. In addition, the U.S. Attorney’s Office has indicted five of the motels and is seeking forfeiture of those properties.

Targeting the monetary assets of those involved in human smuggling is a key facet of ICE’s strategy to combat this dangerous criminal activity. In 2004, ICE nationwide seized more than $7 million from organizations involved in human smuggling and human trafficking. This year, that figure more than tripled to nearly $27 million.

The criminal probe focusing on the Mesa motels formally began in February 2005 after ICE received several leads from the public regarding possible human smuggling activity at the establishments. Border Patrol agents with U.S. Customs and Border Protection assisted ICE in the ensuing investigation.

PROTESTANTS FACE PERSECUTION IN UZBEKISTAN

The embattled Emmanuel Full Gospel Protestant Church in Nukus, capital of the north-western autonomous republic of Karakalpakstan, has failed to overturn the court-imposed ban on its activity, Protestant sources have told Forum 18 News Service from Tashkent.

On Nov. 9, Uzbekistan's Supreme Court ruled to leave unchanged the ban imposed by the Karakalpakstan (located in southwest part of Uzbekistan) Justice Ministry and previous court decisions. Forum 18 reported that against international human rights standards, Uzbekistan bans all unregistered religious activity.

Uzbekistan is located in Central Asia, north of Afghanistan (www.cia.gov/cia/publications/factbook/geos/uz.html).

"The court took no account of the church's views and the verdict means only one thing: it thinks the Church doesn't exist," one Protestant involved in the case told Forum 18 from Tashkent. "This means the judicial system has again - on the usual basis - committed the crudest violation, disregarding the arguments of the church's lawyer."

The Emmanuel Church was the last legal Protestant Church in north-west Uzbekistan, and has faced an intense campaign by the authorities to close it down (see www.forum18.org/Archive.php?article_id=602 and www.forum18.org/Archive.php?article_id=653). The authorities have long been conducting an anti-Christian campaign (see www.forum18.org/Archive.php?article_id=575).

However, Forum 18 reported the church is continuing its battle to be allowed to function legally, and intends to present its case to the Organization for Security and Cooperation in Europe (OSCE), the Uzbek government's human rights center, the general prosecutor's office and even the National Security Service secret police.

Begzot Kadyrov, chief specialist at the government's Religious Affairs Committee, told Forum 18 he had not seen the court documents so was unable to comment on the case. "I don't know why the church is unable to exist," Forum 18 reported he told the news service. "It was decided in Karakalpakstan - it's not our decision." He said that if the church gives him the documents he will study them. "Only then might I be able to do something."

While admitting that difficulties exist for believers of all faiths in Uzbekistan, he claimed such problems are being resolved, though he gave no evidence for this. "There are no problems that can't be resolved," he told Forum 18, "it's just a question of time." Asked why official obstructions to free religious practice have gone on for many years he responded, "They
can't be solved in a day."

Emmanuel Church members complain, Forum 18 reported, that the court reached its decision despite the fact that the church presented once again evidence refuting all the allegations that led to its enforced liquidation.

Meanwhile, the Fores Full Gospel Congregation in the local area of Tashkent's Mirobad district - which used to meet in premises provided by a church member - has been banned from meeting since the end of Oct. The ban reportedly came from the Mirobad district head of administration, Aves Turaev.

"Every day at some time or other the local policeman visits the church building," one church member told Forum 18. "Church members are tired and angry. They can't reconcile themselves to the illegal ban on practicing their religious rights."

On Oct. 23 the deputy head of the local police department for fighting terrorism and two local police officers arrived during the Sun. service and warned that the church should no longer meet.

Forum 18 reported the officers warned of "unpleasantness to come" if the church failed to stop holding services. Church members say that during the raid, the two local policemen looked at the ground in embarrassment, while the other warned the church of serious consequences if it continued to meet, informing the church that the administration chief had issued the orders. "While all this was going on, the congregation was extremely calm, people were praying and even the children were quiet."

The following day, Forum 18 reported, church leaders met the local police officer, who was supportive of the church, and they showed him the legal documents allowing the church to meet. They then went to the district police, where they met the deputy head of the anti-terrorism branch, who was also supportive.

At police request the church leaders returned the following day and discussions began tensely, but again ended warmly, Forum 18 said church members reported. The police verbally said the church could continue holding services. However, district administration chief Turaev overturned this and the housing department under his control also began to deploy pressure.

When church leaders visited the first deputy head of the Mirobad administration, Alisher Nabiev, to try to resolve the problems, Forum 18 reported that Nabiev insisted the congregation stop functioning immediately. He insisted the church could only function once it had gained official registration independently.

"We don't want an official stamp and the other paraphernalia - we're already registered as part of the Tashkent church," Forum 18 reported one church member told the news organization. "More important to us, our church is already registered in the heavens with the Lord God." At the end of Oct., the head of the mahalla, Olga Bedrina, was fired for having allowed the church to function.

Since the church has been banned from meeting, those wishing to worship in church on Sunday have to travel to the main church in central Tashkent. That is too expensive for most of them, church members complained, especially for families with many children, invalids and the poor.

"Church members are angry," one source told Forum 18. Church members have been preparing a joint complaint to Turaev at the Mirobad administration. "It's being proposed that the letter be couched in ‘mild' tones," the source added. "Christians as always will try to reach a compromise with the authorities."

Church leaders pointed out, Forum 18 reported, that even the local police recognize that the church has had a benign influence on the mahalla, a poor district with many alcoholics and drug addicts.

The church insists it has the legal right to exist, Forum 18 reported. Not only have church members in the mahalla written a joint declaration, they cite Article 12 of the Law on Institutions of Self-Government of Citizens, which provides rights for local believers to meet at their request, as well as their rights to practice their faith freely enshrined in the constitution. They say that when the church originally applied for permission to meet, Bedrina consulted the Mirobad district chief who approved it.

Neither Turaev nor Nabiev were available on Nov. 10. Officials told Forum 18 that Turaev was in a meeting and Nabiev was out of the office. Nabiev's aide Bakhtiyor Tovirov said he was not informed of the church closure.

Other members of the Full Gospel Church have been questioned. Forum 18 reported it had learnt that a member of the Tashkent church was detained for questioning by secret police officers Rustam and Akmal (last names unknown) on Nov. 1 about the work of the Church's leader, Bishop Sergei Nechitailo, and his assistants.

The secret police were also interested in the Church's links with fellow-believers abroad, Forum 18 reported. They warned the church member not to meet in his home with fellow-Christians and forced him to write a police statement.

"The situation for Christians remains tense," one Protestant told Forum 18 in early Nov. "Harsh measures have been targeted at Christians, especially at Protestant denominations." The Protestant added that the authorities especially target church members who are ethnic Uzbeks, although these make up a "tiny" part of the population. "Unfortunately in Uzbekistan today there is no Protestant church that doesn't face persecution, whether registered or not."

LOS ANGELES -- Investigators are trying to figure out who stole a computer server from the USC Keck School of Medicine.

The server has names and social security numbers of nearly 50,000 people.

Somebody broke into a computer room last week and USC sent out a letter warning that almost 50,000 people associated with the Keck School of Medicine has personal information that could now be in the hands of a criminal.

While his lieutenant in Iraq, Abu Musab al-Zarqawi, has not only
stepped up the insurgency there but also claimed responsibility for
three suicide bombs in Jordan this week, the al Qaeda leader has
released no audio message since last December and has not been
seen on video for over a year.

Bin Laden's longest public silence since the September 11 attacks on
the United States in 2001 is unlikely to be because he has suddenly
gone shy, U.S. Defense Secretary Donald Rumsfeld remarked
ironically to German magazine Der Spiegel last month.

Intelligence officials and security analysts see two explanations -- that
bin Laden is so tightly holed up that he cannot smuggle out messages,
or that he is biding his time and preparing a major announcement.

Keep that letter and do a credit check once in awhile.

Also, go the major search engines, and maybe every 3 months or so,
run your name and see what you find.

The speech took us by surprise as it
contained instigation against the new

Minister Fouad Saniora, MP Saad
Hariri, the Hariris, the Legislative, the
parliamentary majority and all those
who participated in the uprising of
March 14th and struggled throughout
the years for the realization of the
dream of sovereignty. He described
them as "bullhorns" of the colonial
powers who implement the policies of
these powers and of the Israeli
enemy!

President Assad' words are direct
threats to large groups of citizens,
politicians and media men. He also
tried to sow discord in the Lebanese
interior and create new political or
even sectarian divisions pledging to
do all he could so that the "uprising
imported from Syria" would win over
the Lebanese uprising, which may
lead to new rounds of violence against
Lebanon and its citizens!

It appears to be the Iraq jihadi/terrorist report to the UN, the name is the name on the signed report.
