When the Senate goes on REcess time for Bush to make RECESS appointment. Has been done before on the Supreme Court.

If he does make a recess appointment, does that mean that the Senate has to go to an up or down vote on him when they are seated in January?

Alito could serve til the end of the next session, not just til January, if it came down to a recess appointment.
