Gosh Darn it, if they try to fly above it they'll NEVER get anything done. That's the trouble with the doggone Senate, they spend so much time curtseying they never get down to brass tacks. That danged institution needs to be reformed almost as badly as the Supreme COurt. The Court needs to forget about Roe and start thinking about overturning Marbury v. Madison, by the way.

I take it that you are not aware that judicial review was a standard practice before M v M? It had been done in state courts ala Rutgers v Addington and in the USSC Hylton case (Carriage Tax) both winning sides were argued by Hamilton.

Without judicial review the SC is essentially meaningless since Congress could enact any law it wished without regard for its constitutionality.
