Such judges, of whom we have an overwhelming majority on the USSC, are incapable of understanding why they should make rulings that are supportive of the rights of the American people to a civilized society.

So what. As long as he knows the law and the way to apply it private practice experience shouldn't matter. He has an outstanding record as a judge.
There aren't too many constitutional lawyers in private practice. If we want a strict constructionist, it's probably gonna be a gov't guy -- or Ann Coulter.
