Some years ago, a passenger bought flight insurance, and died when the plane crashed.
The IRS sued the widow, claiming that the insurance policy was taken "in expectation of death" (an old tactic of the dying to transfer assets tax-free).
The judge (God bless him) said that if the guy expected he would die, he wouldn't have taken the flight. Case was thrown out. That was in the pre-activist judiciary (i.e. common sense) days.
