It's not illegal to tell someone who has clearance. So Tenet could tell Cheney and Cheney could tell Libby, but Libby can't tell Miller (assuming Plame really was undercover).

I thought that it was well established that she was no longer undercover, and that there was no crime in revealing her identity because of that fact.

Which did not prevent the MSM from portraying the conversation between Cheney and Libby as a crime or evidence of a crime.

Ahhh...BUT, Novak's first source was "no partisan gunslinger", which IMHO describes Tenet. Rove only confirmed as the second source.

As to Plame's status:

A former CIA covert agent who supervised Mrs. Plame early in her career yesterday took issue with her identification as an "undercover agent," saying that she worked for more than five years at the agency's headquarters in Langley and that most of her neighbors and friends knew that she was a CIA employee.

Even then Libby does nothing wrong if the person who first passed the information did not info the recipients that the info was classified and appropriate procedures/safeguards applied.

If Judith Miller had a security clearance (story) would Libby have been legally able to tell her about Plame? Wouldn't it then have been illegal for Miller to tell someone else about Plame?
