I. Lewis Libby Jr., Vice President Dick Cheneys chief of staff, first learned about the C.I.A. officer at the heart of the leak investigation in a conversation with Mr. Cheney weeks before her identity became public in 2003, lawyers involved in the case said Monday.
Notes of the previously undisclosed conversation between Mr. Libby and Mr. Cheney on June 12, 2003, appear to differ from Mr. Libbys testimony to a federal grand jury that he initially learned about the C.I.A. officer, Valerie Wilson, from journalists, the lawyers said.
The notes, taken by Mr. Libby during the conversation, for the first time place Mr. Cheney in the middle of an effort by the White House to learn about Ms. Wilsons husband, Joseph C. Wilson IV, who was questioning the administrations handling of intelligence about Iraqs nuclear program to justify the war.
Lawyers said the notes show that Mr. Cheney knew that Ms. Wilson worked at the C.I.A. more than a month before her identity was made public and her undercover status was disclosed in a syndicated column by Robert D. Novak on July 14, 2003.

But should it have? It causes be to question his integrity. I'm not sure. I don't know how I would react in the same situation. Would I continue to do work for a traitor if my work were honest and unrelated? Probably. Would I pursue a relationship with the traitor to ensure future completely legal and above board business? I just don't have the answer. It's easy to call Scooter a whore, but we all put up with personally distasteful people in business because we need to earn a living and take care of our families.

Vice President Aaron Burr was indicted by two states for the murder of Alexander Hamilton. Vice President Spiro Agnew negotiated an indictment for failing to pay taxes (rather than bribery), and resigned from office.
Here is a 2000 Dept. Of Justice Memorandum which discusses the subject ............
"The OLC memorandum concluded that all federal civil officers except the President are subject to indictment and criminal prosecution while still in office; the President is uniquely immune from such process. Second, the Department addressed the question later that same year in connection with the grand jury investigation of then-Vice President Spiro Agnew. In response to a motion by the Vice President to enjoin grand jury proceedings against him, then-Solicitor General Robert Bork filed a brief arguing that, consistent with the Constitution, the Vice President could be subject to indictment and criminal prosecution. See Memorandum for the United States Concerning the Vice President's Claim of Constitutional Immunity (filed Oct. 5, 1973), In re Proceedings of the Grand Jury Impaneled December 5, 1972: Application of Spiro T. Agnew, Vice President of the United States (D. Md. 1973) (No. 73-965) ("SG Brief"). In so arguing, however, Solicitor General Bork was careful to explain that the President, unlike the Vice President, could not constitutionally be subject to such criminal process while in office.
In this memorandum, we conclude that the determinations made by the Department in 1973, both in the OLC memorandum and in the Solicitor General's brief, remain sound and that subsequent developments in the law validate both the analytical framework applied and the conclusions reached at that time."

While working in the government, he needs to maintain his ties in the private sector. Right, with a pardoned,shady criminal like Rich. Libby displayed no principles and respect for his current employer, the VP. Even Podesta advised Clinton not to pardon Rich.
For all Libby knew, he was going to be working for Rich again in another 4 years if Bush weren't reelected.
That says it all. Case closed.
