There's no need either to attack or to defend. Thus the best thing is to postpone judgment. Regrettably, Judge Bork is not confirm-able even in 2005. There is a bunch of bean- and vote- counters employed there who obviously presented him with the options, and he chose how much of a fight to pick, based on more information than is available to any of us. The senate does not have many (actually, any) Zell Millers now.
