TEXT OF THE DRAFT IRAQI CONSTITUTION

We the sons of Mesopotamia, land of the prophets, resting place of the holy imams, the leaders of civilization and the creators of the alphabet, the cradle of arithmetic: on our land, the first law put in place by mankind was written; in our nation, the most noble era of justice in the politics of nations was laid down; on our soil, the followers of the prophet and the saints prayed, the philosophers and the scientists theorized and the writers and poets created.

Recognizing God's right upon us; obeying the call of our nation and our citizens; responding to the call of our religious and national leaders and the insistence of our great religious authorities and our leaders and our reformers, we went by the millions for the first time in our history to the ballot box, men and women, young and old, on January 30 2005, remembering the pains of the despotic band's sectarian oppression of the majority; inspired by the suffering of Iraq’s martyrs - Sunni and Shiite, Arab, Kurd and Turkomen, and the remaining brethren in all communities - inspired by the injustice against the holy cities in the popular uprising and against the marshes and other places; recalling the agonies of the national oppression in the massacres of Halabja, Barzan, Anfal and against the Faili Kurds; inspired by the tragedies of the Turkomen in Bashir and the suffering of the people of the western region, whom the terrorists and their allies sought to take hostage and prevent from participating in the elections and the establishment of a society of peace and brotherhood and cooperation so we can create a new Iraq, Iraq of the future, without sectarianism, racial strife, regionalism, discrimination or isolation.

Sure, there’re several outlaw Islamist groups terrorizing and trying to establish a non-democratic state. The government of Indonesia is agressively battling them, as a democracy should.

Do you really think a day/month/year-old "constitution" will supercede 1300 years of brainwashing?

Surah 9:5 “Fight and kill the disbelievers wherever you find them, take them captive, harass them, lie in wait and ambush them using every stratagem of war.” P.S. the "several, ( a few) argument is getting old. Within the context of a "constitution" they are diametrically opposing ideologies.

I don't believe that the intent of this constitution is for apostates to be put to death. The entire cadence of the document is against that. Except for Article Two, it seems to be a liberal (in the broad sense) and humanitarian document. As in our constitution, it will all depend on interpretation.

Sharia law, is sharia law. If this Gov. says that Islam is the religion that law is based on..... How can there be Democracy?

I believe their constitution is very pro-freedom, and that because freedom and reason beat tyranny and dogma, it’s a good document.

Because the mechanisms of democracy are enumerated in their constitution. The people can elect politicians who believe in those principals and who will ensure that they happen.

I'm not saying that it must happen, only that it can.

Of course, we also have to consider the possibility that the country will be taken over by terrorist fanatics after the U.S. leaves.

Allah wants Muslims to kill the infidels (unbelievers) wherever they are found (Koran 9:5), and that peace will come only to those who submit to him (Koran 8:17, 48:29, and 65). The Koran also has Allah saying that unbelievers should be killed (Koran 2:191, 3:141, 4:104, 4:89, 8:12-16, 9:5, 9:73-74, 9:123, 25:52…), that Muslim apostates should be killed or chastised (Koran 2:39, 2:85, 3:85, 3:106, 4:89, 16:106, and 47:25-28), that the heads and fingers of unbelievers should be cut off (Koran 5:33, 8:12, and 47:4), and that Muslims should fight and humiliate Jews and Christians (Koran 5:18 and 9:29).

There is more. For Allah, warfare is good (Koran 2:216) and jihad (fighting in the way of Allah) should continue until only Islam is dominant (Koran 2:193, 3:85, 8:39, 9:33, 35:37 and 61:9). Allah wants his followers to slaughter his enemies (Koran 8:67), allows Muslims to loot (Koran 8:1, 8:41, 8:69, and 59:7)...

Don't you get it? 1300 insane years worth of Sharia Law based on the Koran must STILL be considered.

And just because the mental patients leave the asylum doesn't mean ANYTHING changes.

Keep telling yourself that. The fact is that two things will happen, no matter how much you 'true believers' say otherwise.

A) Laws that come into conflict with Islam will be disregarded or otherwise ignored

B)Eventually 'democracy' that has been forced on an area, that did not have 500 years of some sort of precedent as our nation did, will result in the average Iraqis voting in officials that in turn will bring about an Islamic theocracy.

But I suppose since it was done democratically the Persian superstate (Iran/Iraq) that will eventually come to pass will be acceptable to interventionists like yourself. The constitution will pass, but in a generation or less it will be nothing more than a simple piece of paper. Not because Iraqis aren't capable of understanding the ideal of a Republic, but simply because they don't really want one as it conflicts with their religion

What part don’t I get? The part about how we conquered and colonize Iraq and wrote and imposing a secular constitution for them. Or the part about how we converted them all from Islam so they’d write a purely secularist constitution themselves.

All we committed to from the beginning was to free and democratize Iraq, not colonize or convert it. The design of their democracy was theirs, and the battle to keep it will be theirs. This Islamic-democratic blend is represents the best state of the Iraqi people. You expect Iraq to get worse and fail, okay. But this blended constitution is not the cause, it’s because we didn’t colonize or convert them. I expect Iraq to succeed for the same reason.

No blind optimism without looking at historical evidence is the least ambitious decision you can make. I practice realism. You want to listen to this generation's political leaders and believe it's different? That's your business. But continually hitting your head against a brick wall won't affect the wall. It will just make your head hurt

Oh yea, all that “historical evidence” of failure after sweeping away tyrannical governments from Islamic nations, rebuilding their military and civil service from zero and leading them to develop their own constitutional democracy. It’s hard to ignore all that “historical evidence”. Maybe you could help me find one example it so it’ll have an easier time ignoring it. Otherwise, your just practicing pessimism.

Do you mean Western civilizations and governments trying to establish their form of government in Middle Eastern nations? Noooo, never happened before has it? Perhaps you could point to an example of it working? Exactly how many Muslim nations have working democracies? I know that list is at least 2-3 pages long.
