Fein writes that Miers should be ashamed of seeking a partisan outcome when she is a partisan. You are putting words in Fein's mouth. That is not his argument at all, and it would do your side a lot of credit to properly understand the argument of your opponents before you criticize it.

That's exactly what he said along with his legal opinion that the issue is not a separation of powers one when it can be argued that it is exactly that.
