Petition for the Withdrawal of the Nomination of Harriet Miers to the U.S. Supreme Court

WE ARE REPUBLICANS AND CONSERVATIVES who supported the election of George W. Bush in 2000 and 2004. Today, we respectfully urge that the nomination of Harriet Miers to the United States Supreme Court be withdrawn.

The next justice of the Supreme Court should be a person of clear, consistent, and unashamed conservative judicial philosophy.

The next justice should be a person of unquestioned personal and political independence.

The next justice should be someone who has demonstrated a deep engagement in the constitutional issues that regularly come before the Supreme Court — and an appreciation of the originalist perspective on those issues.

The next justice should be a person of the highest standard of intellectual and legal excellence.

For all Harriet Miers. many fine qualities and genuine achievements, we the undersigned believe that she is not that person. An attempt to push her nomination through the Senate will only split the Republican party, damage the Bush presidency, and cast doubts upon the Court itself.

Sometimes Americans elect Republican presidents, sometimes we elect Democratic presidents. Whatever the differences between the parties, surely we can at least agree on this: Each party owes America its best. There is a wide range of truly outstanding legal talents who share the president’s judicial philosophy. We believe that on second thought President Bush can do better — for conservatism, for the Supreme Court, for America.

If Bush wants to make Miers a judge, he should put her on a federal appeals court. There are much better, more consistent, and predictable picks to the SCOTUS this time round.

In a few years, when Miers has acquired a constitutional philosophy and demonstarted her commitment to strict constructionism, Bush can nominate Miers to replace Stevens if Stevens retires.

Nobody seems to want to wait for the hearings, which kind of makes me question why we even have them.

Joseph Farah is leaving. Maybe Frum will leave too.

Farah was outraged when SCOTUS killed the Texas Sodomy law--urged, demanded and lobbied to have SCOTUS impeached. Of course nothing happened and people forget. No one will ever accuse Farah of being thoughtful.

Frum has never really been a loyal person. Claimed he wrote the "axis of evil" speech and then was surprised when he was fired. He had been given a plum job even though he was a Canadian. No one ever accused him of being grateful.

Both Farah and Frum are big egos who have problems working and submitting to a group effort not of their making. That is why their opinions are inconsequential.

Yeah. We're in big trouble. This is where too much compromise leads. If you make power trump principle, pretty soon you have a crisis like this one.

Nowhere remotely close to as dire as $3/gallon gas or a 60% rise in heating costs...

Actually the "dire" consequences will be for the Republic.

The problem has been, for quite some time, that more folks think about "the party" than "the Republic".

Neither "party" instills much confidence any longer. It is just one is less revolting than the other for many of us, self included.

They are desperate for this not to go to the Senate! These "conservatives" with all their concern for the Constitution want to short circuit it's provisions, like a bunch of seditious students!

It's no longer about Party, it's about principles. The Party's lost it's principles and True Conservatives are trying to shove them back in, from one end or the other.

Yes; isn't that interesting. Is she's really unqualified,
the hearing would be expected to be a major flameout. We
already know she won't dazzle the Dems like Roberts did.

Since the Miers opponents show little restraint in
attacking her qualifications, the impatience can't be
due to a desire to save her the personal embarassment.
