A senator would get confirmed, and by unanimous consent. That is a guarantee. The Senate is nothing if not an ol' boys club. They'd never oppose one of their own. Harry Reid even stated that before Roberts was nominated. And apparently, we all are taking Harry Reid's advice now...

Didn't Harry Reid suggest Bush name a conservative senator when O'Connor first announced her intention to retire?
