So what? Are Souter, Kennedy and Ginsgerg Constitutional scholars? They don't appear to have read the document and certainly think it is a "mutable" document that they can and do change at will.

Ginsburg was on the DC court of appeals for 11 years. Kennedy for 12. I think the constitution must have come up in all those years if only in a peripheral sense as justification for foreign law.

Souter is another story, a sad one for sure but no sadder than O'Connor or Kennedy.
