To assume, however, that Bush is engaged in cronyism because he passed over these individuals for another qualified individual, one whose judgment he is familiar with personally rather than merely as a matter of reputation, is a disservice to both Miers and the president. It also ignores history. Justice Clarence Thomas is among the justices currently revered by conservatives for his service on the Supreme Court, and deservedly so. Yet at the time of his nomination, it would have been difficult to finger Thomas, only recently appointed to the Court of Appeals, as the nation's preeminent jurist, legal scholar, or advocate. He likely was selected in part because his judgment was trusted and in part for political reasons, and the same is likely true of Miers, a woman and evangelical Christian hailing from the underrepresented (on the court) red states.
Conservatives are doing Harriet Miers a grave disservice by their immediate opposition to her. Indeed, the opposition could ultimately prove self-defeating if she is confirmed and begrudges the assaults on her competence and integrity from the right.
Kevin P. Martin is a Boston attorney and a former law clerk to Justice Antonin Scalia.

My criticism here isn't so much of Miers herself, but of this type of attitude displayed by a lot of her new supporters - "Don't criticize your public servants too harshly or they might get upset and take their wrath out on you." What utter anti-republican bilge.
People like this need to be reminded of who's in charge in a constitutional republic, and it's not the public servants. They can remind themselves of this, of course, right after they're done complaining about the "elitists" who are opposed to her nomination...
I agree, was a stupid last statement and frankly does a disservice to Miers.
Yes, let's all follow the fantastic advice of the Boston Globe since this publication has our best interests at heart.
What a joke. The "elitist" thing is one big straw man. Conservatives just want a justice with a documented strict constructionist history, which is exactly what Bush promised in his campaigns anyway.
Kick the plug on this abomination of a nomination.
You sexist elitist! /Sarcasm
"Kick the plug on this abomination of a nomination."
The entire conservative movement agrees with you.
It's an abominomination! A new word is coined.
What moronic point. Thomas was only one of the four stealth candidates to be conservative. Thomas was only nominated after Bush 41 gave us David Souter, another stealth candidate.
Meanwhile compare the stealth strategy to that of the one Bill Clinton. Clinton found known leftists, nominated them and they ended up moving the court to the left.
Sadly, Clinton and the liberals have more intelligence than Kevin and other conservatives that continue to promote the failed stealth strategy.
It is beyond belief with 55 seats in the Senate, we're not getting known originalists appointed. The conservative movement is going to die due to stupidity.
If I recall correctly, Souter had been on the bench for over 10 years when nominated by Bush I. With 10 years of "paper trail" how could he be stealth?
Fair enough, my bad.
I wonder about this myself. Sure there are a lot of issues of concern about the Miers pick, but the language on both sides within the conservative camp has been so over the top and ad hominem and dismissive of the concerns of the other side. People are using against fellow conservatives language usually used for dealing with the left. Surely we can discuss these issues rationally, even if we don't go back to Ronald Reagan's maxim of "thou shalt not speak ill of a fellow Republican." I have a feeling that some bitterness over the Miers brouhaha may be long lasting and may cause damage to the conservative cause.
Everyone but the "trust him" Bushbot brigade...
I didn't know Gore/Leahy supported her. Last I heard Leahy was very skeptical.
(although it's a bit Kennedy-esque; that could be good or bad ;)
Not true.
Rush Limbaugh or Sean Hannity will probably see it and co-opt it. :-)
