Judge orders release of activist who refused to testify (ELF related)

SAN DIEGO – A San Diego federal judge ordered the release Thursday of an animal-rights activist who refused to testify before a grand jury in the case of an arson fire believed to have committed by environmental extremists.

The move came after prosecutors lifted a grant of immunity from prosecution for Danae Kelley, 21, of San Diego, who was expected to be released Thursday afternoon.

Kelley and two other activists were jailed after refusing to testify before a grand jury investigating the $50 million arson fire that destroyed a housing complex under construction in University City in August 2003.

A banner left behind and an e-mail message claimed the radical group Earth Liberation Front was responsible.

Prosecutors would not say why they lifted the grant of immunity they had previously given to Kelley.

Without that immunity, she can now invoke her constitutional right to not incriminate herself and cannot be forced to testify.

A judge had found her in contempt in July when Kelley refused to testify even after being given immunity. In a telephone interview from jail Wednesday night, Kelly said she was not worried about being prosecuted.

The two other activists detained in the investigation, David Agranoff and Nicole Fink, remain jailed.

Investigators raided the Normal Heights apartment she shares with her husband last week and told her lawyer Wednesday that they would return the computers, notes and other items they seized.

Environmental terrorists are still terrorists. If they burned a building, they should pay, and be prosecuted to the full extent of the law.

Sounds like she is in need of some good old fashioned "rendition" to Egypt, Syria or Turkey. I'm sure they can make her talk.

Besides, it's not terrorism if you're attacking capitalists. They have it coming. And they're (The ELF) just rambunvtious college-liberal types letting off steam.
