Rove Said to Testify in CIA Leak Case

Federal prosecutors have accepted an offer from presidential adviser Karl Rove to give 11th-hour testimony in the case of a CIA officer's leaked identity but have warned they cannot guarantee he won't be indicted, according to people directly familiar with the investigation.

The persons, who spoke only on condition of anonymity because of grand jury secrecy, said Special Prosecutor Patrick Fitzgerald has not made any decision yet on whether to file criminal charges against the longtime confidant of President Bush or others.

The U.S. attorney's manual requires prosecutors not to bring witnesses before a grand jury if there is a possibility of future criminal charges unless they are notified in advance that their grand jury testimony can be used against them in a later indictment.

Rove has already made at least three grand jury appearances and his return at this late stage in the investigation is unusual.

The prosecutor did not give Rove similar warnings before his earlier grand jury appearances.

The rumors are that 22 people will be indicted. That's quite a few.

Found this on AP:

You ask ....."Is that not a "target letter"?


I'm no expert in grand jury proceedings but when I read that I took it to mean it is required by the rules to tell people there is no guarantee they will not be indicted at a later time after testifying. Which to me makes sense to tell those who testify that. Otherwise, there wound never be anyone indicted who had appeared before a grand jury.

Does anyone versed in grand jury rules know about a 'rule' that is required pertaining to this?

Not quite the same.

Susan McDougal was sent to jail in September 1996, following her refusal to reply to the order of a federal judge that she answer prosecutors' questions in a grand jury regarding Clinton and Whitewater.

However, Judge Napolitano was just on Fox. He believes that Rove is in trouble and that Rove is trying to convince the jury not to indict him. He also said that it is not set in stone that the the prosecutor has to notify Rove if he is a target.

Miller was "not a target", but really, she was and that's because of that old New York Times case where she and Fitzgerald have some "history" because she supposedly tipped off some terrorists.

It may come down to that there was some "he said, she said" and Rove's lawyers (correctly) believe that the grand jury will be more likely to believe his side of the story if it's fresh in their minds as opposed to a distant memory.

That may be because they're the side with something to leak. I'd like to see some leaks pointing the other way but either there's nothing there or every single one of our guys is just as virtuous as the driven snow.

It does not mean that Karl will be indicted. I would suggest that everyone calm down and take a wait and see attitude. Besides, it was Libby that Miller pointed the finger at.

Thank you for the sanity...My guess is that we're all a little nervous because we don't want our guys to turn out to be criminals just like the guys on the other side. I believe that Karl Rove is too smart to just drop someone's name for revenge and endanger spies around the world. He's not a Clintonista, for God's sake. He actually cares about national security. Besides, didn't Rove claim that he got her name from a reporter? Maybe he's just going to clear up some stuff...like supply some names and dates...the media loves this story because they can spin it so that it sounds like an Italian opera instead of just an everyday tale of political maneuvering and manipulation on the Democrat's part.

Karl Rove and George Bush have survived just fine by saying little and letting the Chicken Littles of the media world spin themselves into a tizzy....think Election 2000, National Guard memos, and Katrina. The media are just drama queens without the Oprah touch.

Could someone please how anyone could be indicted for "outing" Plame when her husband (Wilson) bragged about his "secret agent" wife on his web page some years ago? How can there be a leak when the secret was placed in the public domain by Mr Blabbermouth?

They can't

But there can be indictments for lying ... and that could include reporters that testified

I'm listening to a local guy, Mark Larsen in San Diego. He just interview Molly Henneberg (FOX) re the Rove testimony. She said that when a person is the target of an investigation by the DOJ, they receive a letter stating such. She said that Rove's office says they have never received any such letter .. indicating to her that Rove has just volunteered to testify for his own purposes, not because he's been compelled as the target of an investigation.

Thought you all would like to know this.

Looks like a delaying tactic to me. Like, White House fears indictment in the same week the base is upset about Miers. So Karl asks to testify again, to delay action until "a better time."

Rove volunteered in July. Fitz just took him up on it--after getting a bunch more statements from others. The MSM and DUers are going to be very disappointed...

Towards the end of October - not sure the exact day - Patrick Fitzgerald's term as U.S. Attorney expires 10/24/05 ; )

Another reason for Karl fourth visit being a delaying tactic.

The AP says "anonymous sources" close to the grand jury. Remember the old days when being on a grand jury meant something? Now it's leaks about the leaks.

Here's my theory on the 22. I think some leftie did a search on CIA and charges and came up with a not well publicized story about some prosecutor charging 22 CIA types by some prosecutor in Italy.

I don't know how rumors get started but I can't believe it's 22 unless it's half of the White House Press Corps and half the White House Staff.

Anyway, that's my goofy theory on how that rumor got started. I going to go out on a limb and say it's not 22.
