If Harriet Miers had the open record we all want the Democrats will fillibuster it and then what? She would get Borked, if we had 60 seats I say go for it, but we don't we really don't have a majority in the Senate, because we never know what the RINO's are going to pull.

That may be part of why Bush choose Miers. Mark, and many other conservatives feel that the fight could have been won for a more conservative justice, so they are disappointed that Bush didn't choose to try to fight. They feel the time is right for the congress to pass the Constitutional Option if necessary. It's like a family fight, the rift will ment.
