Miller Agrees to Testify in CIA Leak Probe

WASHINGTON -- After nearly three months behind bars, New York Times reporter Judith Miller was released from a federal prison Thursday after agreeing to testify in the investigation into the disclosure of the identity of a covert CIA officer, two people familiar with the case said.

Miller left the federal detention center in Alexandria, Va., after reaching an agreement with Special Counsel Patrick Fitzgerald. Legal sources said she would appear before a grand jury investigating the case Friday morning. The sources spoke on condition of anonymity because of the secrecy of the grand jury proceedings.

The sources said Miller agreed to testify after securing an unconditional release from Vice President Dick Cheney's chief of staff, I. Lewis "Scooter" Libby, to testify about any discussions they had involving CIA officer Valerie Plame.

Miller will testify that she told Libby about Plame, but not who told her in the first place.

My money's on V.Plamne being the source.

Given Miller's beat, it is quite conceivable that she knew Plame from way back, and no one had to tell her about Plame. Perhaps they are long-time acquaintances.

It would be very interesting to know if Miller attended Wilson and Plame's wedding.

If that is the case, then it must not be anyone in the administration. If it were, it would be stupid to give a waiver to Miller. If she were going to protect her sources - and credibility as a reporter, then the leaky one would have gotten away with leaking, and/or perjury. If Miller testified without a waiver, no one would have trusted her again to be her “anonymous” source. If someone in the administration did commit perjury without checking out Plames’ status, then they were…well, stupid.

The limiting of the scope is just spin from the NY Times. They are just trying to blow smoke when the truth is Judith was told by Fitzgeral testify on Friday or her criminal contempt indictment will be released on Monday and she'd have to spend another 6 months in jail. Fitzgerald is playing hardball.

Do not believe the NY Times statements on limiting the scope. They are not telling the truth about what's happening with Fitzgerald. Ask Bill Keller if they were told that Miller was going to be indicted on Monday if she didn't testify tomorrow and watch them squirm. The Times is pulling a Sid Blumenthal to try to coverup the fact that Miller was on her way to a criminal contempt indictment on Monday and an extended jail stay for at least another 6 months.

Amazing stuff. I presume that this is more than idle speculation on your part and that you have a connection somewhere. Anyways, I sure hope you are correct about all this. It brings joy to my heart.

Regards,
LH

Why are we even bothering to figure this out? The Washington Post has this thing solved.

isn't it clear the "the source" is Libby?

Well, actually, no it isn't. It's clear that the Post wants us to think so, but that's a different question altogether.

"no, something is going on here. the timing is suspicious. first Frist, then this Delay thing, and now all of a sudden she pops up and agrees to testify? in a month, the Fitzgerald grand jury will be over. at that time, she would be released - or could decide to testify then to avoid a criminal contempt charge or continue to be held if further proeedings convene.

why is she doing this now?"

I was thinking the exact same thing.
Add to what you said w the President's #'s down (per Dim-heavy polls - but now on the rise again)and Hellerstein now says the ACLU won and the photos & videos of AG should be released (hasn't he been thinking about this since Aug - curious it came out today, but maybe this is the day he said he'd make his decision - I don't recall). Guess Hellerstein and Judy couldn't let the President smile and Roberts having his big day today.

The Dims new talking point w Delay and Frist are that the Repubs are 'corrupt'. Perhaps Judy thinks she can add to that now. Could also be to take the news off of the corruption in LA - - the Dims know it's all going to come out and they can say the Pubbies are corrupt, too. Sorry, I'm rambling and need to collect my thoughts better, but something is up.

Also a bit curious she's testifying on a Friday, as people don't listen to/read the news as much over the weekend (if it's good news for Bush) OR, perhaps, she's trying to get it out for the Sunday Talk (Smear) Shows??

Lol. I tend to agree with you. I have not been in a DC holding tank but I have been to club fed in Chicago - full of DC's finest gang members (not just Illinois politicians but actual DC gang members - DC being a federal jurisdiction) - the DC gangs owned the place and it was worse then being stranded in downtown Detroit at 3 am.

Bill Keller, the executive editor of The New York Times, said that Mr. Fitzgerald had assured Ms. Miller's lawyer that "he intended to limit his grand jury interrogation so that it would not implicate other sources of hers."

I'd sure like to know what this means. Who are her other sources and why wouldn't that information, if related, be subject to this investigation.

Hold up just a second here. According to the subpoena, Miller was not jailed for refusing to give up a 'source'. She was jailed for refusing to relate a conversation with a 'specified government official'. (who apparently is Liddy?) There is NOTHING in the subpeona about this govt. official being a 'source'.

"In the meantime, on August 12 and August 14, grand jury subpoenas were issued to Judith Miller, seeking documents and testimony related to conversations between her and a specified government official “occurring from on or about July 6, 2003, to on or about July 13, 2003, . . . concerning Valerie Plame Wilson (whether referred to by name or by description as the wife of Ambassador Wilson) or concerning Iraqi efforts to obtain uranium.” Miller refused to comply with the subpoenas and moved to quash them. The District Court denied Miller’s motion to quash. Thereafter, the court found that Miller had refused to comply without just cause and held her in civil contempt of court also. She also has appealed.

Today I commented to a friend that all the Dems needed to complete their wish list would be if Karl Rove's name hit the headlines again.

It's right out of the play book. Last week on the McLaughlin Group, Eleanor Clift knowingly announced that the Rove issue would be back soon.

I think that Fitzgerald has given up the idea of indicting anybody for "leaking" Plame's identity. His focus now is on perjury. I gather he thinks somebody has testified falsely to the grand jury, and that Miller's testimony can prove it. The only way that could be true is that the testimony concerned something said to Miller, either by the witness or by a third person in his presence. I say something said to Miller, not by her, since could not have had an obligation to withhold what she herself said.

Like Susan McDougal, who came out a hero after admitting that she spent two years in jail because if she went before the Grand Jury she would have to lie.

Of course, she blamed having to lie on the prosecuter, as if he could put words in her mouth, but to her supporters that makes perfect sense. They are used to lying when told to.
