Judge Orders Release of Abu Ghraib Photos

NEW YORK - Pictures of detainee abuse at Iraq's Abu Ghraib prison must be released despite government claims that they could damage America's image, a judge ruled Thursday.

U.S. District Judge Alvin K. Hellerstein ordered the release of certain pictures, saying terrorists in Iraq and Afghanistan have proven they "do not need pretexts for their barbarism."

The American Civil Liberties Union sought the release of 87 photographs and four videotapes as part of an October 2003 lawsuit demanding information on the treatment of detainees in U.S. custody and the transfer of prisoners to countries known to use torture. The ACLU contends that prisoner abuse is systemic.

Maybe if the " enemy' used these pictures in their propaganda, it might discourage other space cadet Islamic vapor heads from doing the same sort of criminal behavior.The picture of the guy with his jock strap under his chin is far less inflaming than the pictures that we've had to endure of Innocent people having their heads sawed off while crying and pleading.

Bush needs to put Karen Hughes on the job, she can explain that this is just innocent hazing, an expression of playful american values, etc. That should satisfy the muzzies.

I believe it's a coordinated effort against the President, Conservatives and the country.

Katrina, Frist, Delay, Abu Ghraib, gasoline, energy and soon heating oil..........etc.

Fighting international terrorism is a picnic compared to fighting domestic liberal terrorism.

And why can't these pics just accidently slip into a paper shredder? Kinda like hitlery's rose law firm records huh? Or better yet, they can be stuffed in Bergers pants - it seems that those documents have mysteriously dropped off of the planet....

This jerk's decision won't be upheld by the appeals courts. When the hell are these people going to remember "WE WERE ATTACKED ON 9-11," and that our troops are shedding their blood so we can be free of this enemy vermin

Isn't it a violation of the Geneva Convention (which doesn't apply to terrorists, but the ACLU thinks it does) to release photos of men held in captivity?

Hey if burglar gets away with a slap on the wrist for accidently losing classified documents, someone might have to accidently lose those photos. For the good of the troops!!

You must be joking. If this is the punishment meted out to muderous criminals by the Americans, it would act as recruitment tool.

Agreed. But the Western media and the enemy's media don't distribute those pictures of people having their heads sawed off to the general public. The Abu Garib pictures will be on the front pages of the newspapers around the world and on television. It is common sense. You don't give the enemy ammunition to use against you.

What types of materials are not available under FOIA?

Although most FCC documents, records, and publications are accessible through FOIA, some types of FCC records are not available. Section 552(b) of the FOIA, 5 U.S.C. § 552(b), contains nine types of records which are routinely exempt from disclosure under the FOIA:

Records classified national defense or foreign policy materials, 5 U.S.C. § 552(b)(1);

Internal personnel rules and agency practices, 5 U.S.C. § 552(b)(2);

Information specifically exempted from disclosure by another statute, 5 U.S.C. § 552(b)(3);

Trade secrets and commercial or financial information obtained from a person and privileged or confidential, 5 U.S.C § 552(b)(4);

Inter- or intra-agency memoranda or letters which would not be available to a party in litigation with the agency, 5 U.S.C. § 552(b)(5);

Personnel, medical and similar files, disclosure of which would constitute a clearly unwarranted invasion of personal privacy, 5 U.S.C. § 552(b)(6);

Records compiled for law enforcement purposes, 5 U.S.C. § 552(b)(7);

Records relating to the examination, operations, or condition of financial institutions, 5 U.S.C. § 552(b)(8); and

Oil well data, 5 U.S.C. § 552 (b)(9).

Even if a record falls within one of these FOIA exemptions, the FCC may, in some circumstances, release the records, depending upon the exemption at issue and the circumstances of the FOIA request.


Are there any privacy considerations which the FCC must consider in granting your FOIA request?

Under the FOIA Exemption 6, 5 U.S.C. § 552(b)(6), and the Privacy Act, 5 U.S.C. § 552a, the FCC may be prohibited from disclosing information about an individual from a system of records without the written consent of the individual to whom the record pertains.


Can the FCC deny my FOIA request?

Yes. If the Bureau or Office that is the custodian of the records determines that there are no records responsive to your request, or that one or more of the FOIA exemptions described above applies to the documents you request, your request will be denied in writing.
