The problem is, from what I believe, that the police officers refused to give them receipts. The news story mentioned that. They were just taking the guns. No receipt, no nothing.

I say confront every welfare queen gun owner who sucks off the cash and support of all the responsible gun owners who protect their rights. There are a bunch on FR. They slam the NRA and son't do anything but squeal about how the NRA isn't any good. Welfare Queens - all of them.

What was the wording of the court order? Did it provide any recognition to "individual rights"? I haven't seen it, so I'm shooting from the hip here. I'd be extremely surprised if the court invoked the Second Amendment. I'd say the best we could expect is that the court cited LA RKBA statute violations.
It's also possible the court didn't say the confiscation itself was illegal, just the way the order was implemented.

IIRC, stare decesis(sp?) compels this court to follow the dicta of the 5th Circuit in the Emerson decision that the RKBA is an individual right, but I'm no lawyer.

Let's hope it's not overturned on an appeal. I don't think Compass, Nagin or the New Orleans DA's office would *dare* to appeal this--
I'll see if the full text is available online yet, although I don't have access to LexisNexis or the pay-per-page service the Federal Courts have set up.

GREAT !!! Thanks to the NRA. I was amazed that a police chief would issue such an order. Obviously he was educated in a 'publik skool' and had no idea what a 2nd amendment was nor was he cognizant one even existed.
