There were many anti-Michael signs at the Vigil. He was pictured on one poster with OJ and Scott Peterson. We should have had a poster contest while we were waiting for someone to have enough courage to save Terri. Leadership from the top down was sadly lacking...

There doesn't seem to be ANY mechanism for the reversal of a finding of fact error. Appeals courts reverse on an incorrect application of law, do they not?

Appellate courts can reverse on either ground, error in application in law or error in finding of fact. However, appellate courts give great deference to finding of fact in the court below - there is a "bias" that trial courts rarely make error in fact finding. But "rarely" is not the same as "never." An applellate court will always reserve the right to reverse on error of fact finding. Hence my point that civil law gives to much weight to finding of fact in lower courts, when the remedy involves taking a life.

As for the propostion that appellate courts can reverse based on errors in finding of fact, see Fed. Rules of Appellate Procedure.

FRAP 40(a)(2) Contents. The petition must state with particularity each point of law or fact that the petitioner believes the court has overlooked or misapprehended and must argue in support of the petition. Oral argument is not permitted.

If appellate courts lacked the power to reverse on errors of fact, then a lower court could persist as a kangaroo court. That is not justice, and the legal system is legitimate only to the extent it is accepted as being just.

True. He also said he needed the first round of money so he could go to school, become a nurse, and take care of Terri for the rest of his life. He claimed that's what he promised her he'd do. Strange how that promise changed to a promise to torture her to death.

I appreciate what you're both trying to say, but you both missed the mark. The monster's form does not resemble human, and he's not capable of doing anything upright. It would be convenient to believe his supporters were fooled because he took on human form, or at least walked upright. There's no easy explanation for anyone being fooled by someone so lacking in a disguise.

The Schindlers and Michaels had a falling out over the lawsuit settlement money...that is, it was, at least in part about money.

You're right. Terri's Dad wanted Terri to get the medical attention that the money was awarded for, and Michael wanted to kill Terri and keep her money. So yeah, it was, at least in part about money.

We tend to get more upset over Michael's breaking of the 6th commandment, but that doesn't mean we're totally ignoring his breaking of the 9th. Let's not forget his breaking of the 1st, 4th, 5th, 7th, 8th, and 10th. It can be argued whether or not he broke the 2nd and 3rd. Still, his breaking of the 6th commandment will garner the most focus.
