I expect it to be over 40 against on the basis that Judge Roberts declined to answer too many questions, and that the Dims will filibuster. Otherwise, it will weaken any argument they may have to invoke the "extraordinary circumstances" exception and filibuster President Bush's next nominee. But then again, when has a weak argument stopped the Dims?
I'd love to see them try and filibuster this, but I don't think it's gonna happen.

I wouldn't put it past them, but anyone watching these hearings would have to conclude that Roberts is undeniably qualified and has given no hint to being right-leaning. If they do, they will look ridiculous. Of course, that's not a bad thing.
