Oh yes there is. The 4th and the 9th have come down with diametrically opposed holdings. This judges ruling was based on the 9th's precedent that POA is unconstitutional. And the 4th Circuit has held exactly opposite. It is time for the Judges up on Mt Olympus to have a BM or get off the pot.
