HAYWARD, Calif. — Two men who had sex with a transgender (search) teen were convicted of murdering her after they discovered she was biologically male, but a third defendant's case ended in a mistrial.
In their verdict Monday, the jury rejected defense arguments that the killing of 17-year-old Gwen Araujo amounted to no more than manslaughter (search).
"It's murder," said Gwen Smith, who maintains a Web site memorializing people believed to have been killed because they were transgender. "And a murder conviction shows that transgender lives are valuable."
Michael Magidson and Jose Merel, both 25, face mandatory sentences of 15 years-to-life in prison for second-degree murder in the killing of Araujo, who was beaten, tied up and strangled. They were cleared of hate crime charges.

It sickens me that the AP chose to report the victim as "She" when they know it was a guy with a terrible mental disorder that made him think he was a woman... or else, he was just a gay guy that would rather pretend to be a woman than admit he was a homo.

There are some pretty interesting studies out there that suggest that transgenderism is essentially a birth defect in the brain. I'm not a scientist by any means, but from what I saw of the studies, it was fascinating.
Essentially, what they said was that somewhere along the developmental line in the womb, the body is told "you're male" (or female, as the case may be.) The brain, however, is told "you're female." It's really pretty fascinating.

Yeah, the reporting is just horrible. The murder victim first committed a crime against his attackers. That doesn't excuse them, but neither does it make him an innocent victim. He's a guilty victim.
Exactly so. They obviously didn't care where they put their organs, at least at the time they were doing it. Nobody but themselves to blame if they can't tell a man from a woman.
They deserve the same penalty as any other murderers.

Of course murder is murder. This person was killed and thats murder. If someone is so stupid they cant recognise a male dressed as a female or doesnt care it doesnt give them the right to kil that person.
Why does the article refer to the transvestite as She. If you have a penis you are a he no matter what you think you are, If you have your body mutilated by cutting off the sex organ you are still a He with your penis cut off.If you think you arent a HE lets see your ovary's.

I think the correct charge is manslaughter, (although not politically correct). I suspect it was an over-reaction to the shock of the discovery. Which I find reasonable, although excessive. I fault the resultant killing on the transgender pervert for tricking the other two.
The ancient Celts viewed homosexuality the same as treason, this is a case of deception where the comparison is aptly fitting.
