FEMA did a better job than could be expected with providing disaster relief after Hurrican Katrina struck. However, they are also charged with "before the fact" mitigation" at which they failed miserably.

As I read CFR TITLE 44 (and admittedly, reading between the lines is prerequisite), FEMA works under Homeland Security which is an executive department. Federal authority always supercede local authority in disasters of this magnitude, given that the repercussions are national in nature (i.e. disruption of energy and food supplies), and especially in light of the perhaps $100 billion cost to taxpayers nationwide.
That having been said, there is no excusing the gross incompetance and possible corruption at the local and state levels of Louisiana's government.

That is flat out wrong. Unless the governor cedes control or has it taken from her under the Insurrection act, she is in control. FEMA and the National Guard said that as long as there was one functioning New Orleans municipal policeman they were still subordinate to his authority and would do what he said.
