Sounds like Gen. Honore isn't going to be doing Nagin's bidding about forcibly removing citizens from their homes.
So how long until Nagin starts using emminent domain to seize residential property for something other than flood control?
There's more than one kind of troop there. Nagin/Blanco have complete control of the National Guard. Have had ALL ALONG.
The active duty military (Honore's command) is provided only for evacuation, see air bridge on Saturday last. They may also do some search and rescue, and will place relief supplies, etc. But they will NOT perform any law enforcement whatsoever. It's illegal.
Nagin can have as many Nat'l Guard as he needs to cause forcible evacuation - all he has to do is call for them and give them orders.
Nobody told Nagin apparently since he thought he could order Gen. Honore's troops as well.
I see they had the crying guy on Fox this morning.

He made it clear that only the NO police can keep law and order as the military is only there for search and rescue. He also said only NO police can force people from their homes. LOL
That might be difficult given that a lot of them have shown up in Houston and I don't think they are even being ordered back.
Honore was supposed to be on Fox sometime this morning.

90 horses, mules retrieved after Katrina

BATON ROUGE- Post-Hurricane Katrina rescue efforts have saved 70 horses and mules in the New Orleans area from the storm and subsequent flooding. Lamar-Dixon Expo Center, the central staging area for horses retrieved from the New Orleans area, now houses 90 horses and mules.
"Nineteen carriage horses and mules were reached Monday from the downtown area" said Bonnie Clark, president of the Louisiana Horse Council.
LSU Field Service Veterinarian Dr. Dennis French has been the primary veterinarian at Lamar-Dixon and has coordinated all health monitoring duties with the assistance of a number of LSU veterinary students who have worked diligently under his supervision for days.
"We've had a few health issues with horses that have come in that have been drinking the saltwater from the flooding" said French. "The students and I have administered fluids and are working to stabilize them right now. I'm not seeing any depression or any fevers, nothing that would indicate a contagious condition so at this point I think that all of the symptoms I'm seeing are purely the result of these horses being in a traumatized state."

I really do wonder, though, how much of Nagin's sudden consideration for his residents has been affected by thoughts of emminent domain dancing in his head. And I don't mean for flood control projects. I wonder how many of the folks trying to stick it out are worried that the local and state governments may try to seize their homes and neighborhoods for commmercial development, or for projects that would benefit commercial development?
I hadn't thought about eminent domain with regard to NO; it would just be a further shame what damage that SCOTUS ruling did if that's another reason people risked their lives. A SHAME.
Did anybody else hear the statements of the Judiciary Committee yesterday re: the delay of the Roberts hearings? On one network (can't remember which; it was CNN, Fox, or MSNBC - I was flipping back & forth), Arlen Specter said that the hearings would be delayed, and that the FIRST request for the delay came from the MAYOR OF NEW ORLEANS!! He then mumbled something about him (the mayor) being head of the "mayors' advisory group" (?)....
But I'll bet you anything that emminent domain considerations are starting to come into play. If I were the folks with property in NO, I'd be on guard.
Why are they back so soon is a very good question. What the heck is going on there?

St. Pete Times reporter shot and wounded in Baton Rouge
ST. PETERSBURG, Fla. (AP) -- A reporter from the Saint Petersburg Times newspaper is recovering after being shot while covering Hurricane Katrina in Baton Rouge, Louisiana.
Thirty-four-year-old Marcus Franklin was shot last night. Newspaper officials say Franklin was treated and released from a Baton Rouge hospital.
Franklin had been reporting on evacuees returning to their homes. He says he was on his way back to his Baton Rouge motel at 11:30 pm when he was stopped at a dimly lit intersection.
He says a man with a black revolver appeared at his window.
After driving off, Franklin realized he had been shot in the stomach and called the paramedics. Newspaper officials say doctors decided not to remove the bullet because it was too risky. He was scheduled to fly back to Saint Petersburg Tuesday.
