Yes, they could have, just not legally. Once the threshold of requiring the law to be upheld is crossed, all bets are off. When a federal agency can override those in lawful control, the risks are more enormous than a CAT 5 hurricane ever could be.

Whatever idiot sent people to the Convention Center should be fired. That's where lots of wrongful deaths occurred. It gave Geraldo time to get there to cry on my tv. FEMA and Homeland Security should have watched tv once in awhile to see that Americans were dehydrating, starving, having heatstroke, diabetic shock, heart attacks and were also being raped.

Michael Brown said he didn't know about "the convention center". He's the only person in America who didn't know.

That's the crux of the matter. In this case, I say legalisms and laws be damned. Save lives and alleviate suffering. Just as we praise the 18 year old who broke the law and commandeered a school bus to save himself and others, we need to assist our fellow citizens in the name of morality and humanity.
