Delgado didn't want to leave his hometown in Monterrey, Mexico, but his father — a teacher who made little money — continued to pressure him.
Delgado finally came to Texas on a tourist visa and moved in with an aunt. The visa quickly expired, but last week, the 21-year-old became a San Antonio College student, thanks to a Texas law enacted in 2001 that allows undocumented immigrants to qualify for in-state tuition at public schools.
That law is being challenged by the Washington Legal Foundation, a conservative legal and advocacy organization that argues Texas is breaking federal law by giving migrant students an unfair break.
A complaint filed with the Department of Homeland Security charges Texas is violating a 1996 federal law that says if public colleges offer discounted rates to undocumented students, they must do the same for U.S. citizens from out of state. Students who live out of state typically pay significantly higher tuition than in-state students at public schools.
Lamar Smith, the Republican congressman from San Antonio who wrote and sponsored that federal law, said he supports the foundation's effort.
"States shouldn't treat illegal immigrants better than American citizens," Smith said.
Educators don't see it that way.
"These are members of our community," SAC President Robert Zeigler said. "We want to encourage them to get an education and better their lives. We do not want to make it more difficult for them."

All educators, colleges, universities want is $MONEY$ hands down. They don't care how or where it comes from. If they could steal it, they would.
Gee, I can't imagine why people wonder why there's a lack of respect for the law, especially when you've got the chief law enforcement officer who purjurs himself before a grand jury, subborns purjury, etc... But then, it's not all just him. You've got elected officials who publicly break the laws of the land, and wonder why people have no respect for the law.

What's truly sickening is that a returning soldier from Iraq was told by Austin Community College that his service in Iraq EXCLUDED him from in-state tuition..only after a media blitz did ACC come under enough pressure to find a little used Texas law that finally DID allow it..

No they freakin' aren't members of my community. They're crimminals taking educational opportunities from my own children. For every illegal that gets admitted that's one less opening for a Texas and/or US citizen. It's all our tax dollars. It's all our children's future.

I know a young lady, a Navy veteran, that can't afford to go to college now, because the Texas school wants her to pay the higher out of state rate! I told her she should have told them she was an illegal alien!:^(

Too bad you can't sue the government to do their job. Here's an idea, we can all go to out of state colleges, just the opposite. You could choose any college as long as it's not in your home state.
If ANY access to higher education by these illegals is allowed, it should be that they are charged "out of state" rates. The fact that this simple alteration was ignored by the state legislators tells you where their loyalty lies.
It seems to me some U.S. citizen students could sue on the Constitutional basis of unequal treatment.

So, what he saves on in state tuition is sent to Mexico. Just f-ing great!
